On roll call, the following vote was recorded: AYE: Brown, Cavazos, James-, Tarbutton NAY: None ABSTAIN: Kraus, Norris, Stokes The Mayor introduced for consideration the appointment of a Health I Officer. Mayor Kraus moved to appoint Dr. Charles VonHenner, who has been Acting Health Officer, to the position. Mr. Cavazos seconded the motion, which passed unanimously. The Mayor introduced for consideration an Ordinance on second reading having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, N,lENDING SECTION 3 OF THAT ORDINANCE I~ICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 37.24 ACRES OUT OF THE J. M. VERAMENDI LEAGUE NO. ONE FROM "R-l" (SINGLE FAHILY RESIDENTIAL) TO "OP" (OFFICE/PROFESSIONAL). Mr. Stokes moved to approve the Ordinance on second reading. Mr. Cavazos seconded the motion, which passed unanimously. The Mayor introduced for consideration an Ordinance on emergency having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, AMENDING CHAPTER 18, ENTITLED "PARKS AND RECREATION" OF THE CODE OF ORDINANCES OF SAID CITY TO PROHIBIT THE BRINGING OF GLASS BEVERAGE CONTAINERS INTO CITY PARK, RIO VISTA PARK OR LUCIO PARK OR THE I POSSESSION OF SUCH CONTAINERS IN SAID PARKS; PROHIBITING THE POSSESSION OF GLASS BEVERAGE CONTAINERS IN OR ON THE SAN MARCOS RIVER WITHIN THE CORPORATE LIMITS OF SAID CITY; AND DECLARING AN E~1ERGENCY . Mr. Cavazos moved to adopt the Ordinance on emergency. Mr. Brown seconded -the motion. Council discussed the fact that the City did not have adequate personnel to actively enforce the Ordinance and that, as stated in the preamble, enforcement would be achieved by citizens filing complaints through the Municipal Court. The vote was for unanimous approval. The Mayor introduced for consideration a public hearing on a proposed zoning change. Mr. Ed Salinas, the applicant, was present to state his request. No one spoke in opposition. The Mayor then closed the public hearing. The City Secretary then read the Ordinance in its entirety which had the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 20.91 ACRES OUT OF THE J. M. VERAJ\1ENDI LEAGUE NO. TWO, LOCATED AT 2213 RIVER ROAD, FRGr1 "R-l" (SINGLE FAr-lILY RESIDENTIAL) TO "HH" (MOBILE HOME DISTRICT) . Mr. Cavazos moved to approve the Ordinance on first reading. Mr. James I seconded the motion, which passed unanimously. The City Manager pointed out that the property was located in the floodplain and that the appli- cant was aware of that fact.
