Mr. Brown moved to appoint James Smith. Mr. James seconded <br />the motion. On roll call, the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, James-, Tarbutton <br /> <br />NAY: None <br /> <br />ABSTAIN: Kraus, Norris, Stokes <br /> <br />The Mayor introduced for consideration the appointment of a Health I <br />Officer. Mayor Kraus moved to appoint Dr. Charles VonHenner, who has <br />been Acting Health Officer, to the position. Mr. Cavazos seconded the <br />motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on second reading <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />N,lENDING SECTION 3 OF THAT ORDINANCE I~ICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY <br />23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 37.24 ACRES OUT OF THE <br />J. M. VERAMENDI LEAGUE NO. ONE FROM "R-l" (SINGLE FAHILY RESIDENTIAL) <br />TO "OP" (OFFICE/PROFESSIONAL). <br /> <br />Mr. Stokes moved to approve the Ordinance on second reading. Mr. Cavazos <br />seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on emergency having <br />the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, <br />AMENDING CHAPTER 18, ENTITLED "PARKS AND RECREATION" OF THE CODE OF <br />ORDINANCES OF SAID CITY TO PROHIBIT THE BRINGING OF GLASS BEVERAGE <br />CONTAINERS INTO CITY PARK, RIO VISTA PARK OR LUCIO PARK OR THE I <br />POSSESSION OF SUCH CONTAINERS IN SAID PARKS; PROHIBITING THE <br />POSSESSION OF GLASS BEVERAGE CONTAINERS IN OR ON THE SAN MARCOS <br />RIVER WITHIN THE CORPORATE LIMITS OF SAID CITY; AND DECLARING AN <br />E~1ERGENCY . <br /> <br />Mr. Cavazos moved to adopt the Ordinance on emergency. Mr. Brown seconded <br />-the motion. Council discussed the fact that the City did not have adequate <br />personnel to actively enforce the Ordinance and that, as stated in the <br />preamble, enforcement would be achieved by citizens filing complaints through <br />the Municipal Court. The vote was for unanimous approval. <br /> <br />The Mayor introduced for consideration a public hearing on a proposed <br />zoning change. Mr. Ed Salinas, the applicant, was present to state his <br />request. No one spoke in opposition. The Mayor then closed the public <br />hearing. The City Secretary then read the Ordinance in its entirety which <br />had the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 20.91 ACRES OUT OF THE <br />J. M. VERAJ\1ENDI LEAGUE NO. TWO, LOCATED AT 2213 RIVER ROAD, FRGr1 "R-l" <br />(SINGLE FAr-lILY RESIDENTIAL) TO "HH" (MOBILE HOME DISTRICT) . <br /> <br />Mr. Cavazos moved to approve the Ordinance on first reading. Mr. James I <br />seconded the motion, which passed unanimously. The City Manager pointed <br />out that the property was located in the floodplain and that the appli- <br />cant was aware of that fact. <br />
