<br />99. <br /> <br />AGREEMENT FOR CLAIM ADMINISTRATOR <br /> <br />This agreement ("Agreement") effective the 1st day of August, 1999 between the City of San <br />Marcos (the "Company"), a Texas municipal corporation and Group Administrators-San <br />Antonio, Inc. (the "Claims Administrator"), a Texas corporation. <br /> <br />SECTION I <br /> <br />The Plan <br /> <br />1.1 The Company has adopted a self funded Health and Welfare Benefit Plan ("the Plan") <br />which it intends to be governed by the Employee Retirement Income Security Act of 1974 <br />("ERISA") as amended, providing means by which eligible employees (and their <br />dependents) of the Company can secure the employee welfare benefits set forth in the <br />Plan. <br /> <br />1.2 The administrator of the Plan (as defined by ERISA) (the "Plan Administrator") is the <br />Company. <br /> <br />1.3 The name of the Plan is "The City of San Marcos MedicalIDental Benefits Plan". <br /> <br />1.4 The effective date of the Plan is August 1, 1999. <br /> <br />1.5 The Plan Administrator hereby appoints Group Administrators-San Antonio, Inc., an <br />independent third party claims administrator ("Claims Administrator"), to perform certain <br />functions for the operation of the Plan. <br /> <br />SECTION II <br /> <br />The Claims Administrator <br /> <br />2.1 The Claims Administrator, within the scope of its professional ability and its employment <br />under this Agreement, shall provide certain services for and shall assist the Company and <br />the Plan Administrator in the administration of the Plan as it may be requested and <br />authorized from time to time. Such services shall include, but not necessarily be limited <br />to, the following: <br /> <br />(a) Preparation of Plan Document and Summary Plan Description. <br /> <br />(b) Preparation of Identification Cards. <br /> <br />1 <br />
