141. <br />Regular Meeting March 24, 2003 Page 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CITY CODE SECTION 42.102 TO DESIGNATE AN AREA WITHIN THE <br />CITY AS THE DUNBAR HISTORIC DISTRICT, ALONG THE 200 THROUGH 600 <br />BLOCKS OF MARTIN LUTHER KING, JR. DRIVE, THE 200 THROUGH 500 BLOCKS <br />OF CENTRE STREET, AND THE 200 BLOCKS OF HERNDON STREET, SHADY LANE, <br />SOUTH COMANCHE STREET AMD SOUTH FREDERICKSBURG STREET; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Ollie Giles encouraged the Council to approve the Ordinance. <br />She stated this is very important for the Dunbar neighborhood. 2) Johnnie <br />Armstead thanked the Council for considering this Ordinance. She feels <br />this is a positive move, since the Dunbar District currently has no <br />protection of its buildings. 3) Sherwood Bishop stated the Dunbar <br />neighborhood is an important district to our community. He stated there <br />are several historic buildings in this neighborhood, which need to be <br />protected. 4) Richard Gachot encouraged the Council to pass this <br />Ordinance. 5) Rodney Van Ouderkerke stated he is the Chairman of the <br />Historic Preservation Commission. He stated the Historic Preservation <br />Commission is in support of this Ordinance. No one else wished to speak, <br />so Mayor Habingreither closed the public hearing. Ms. Tatum moved for <br />approval of the Ordinance on first reading and Mr. Mayhew seconded the <br />motion. Mr. O'Leary stated this is a neighborhood with old historic <br />homes. He stated if this Ordinance is adopted, then the homeowners who <br />want to change the exterior of their homes within this district would have <br />to go before the Historic Preservatio~ Co~issio~ ~or approprlate~ess. He <br />stated this would also make demolition of structures more difficult unless <br />the structure was deemed unsafe. The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE CITY <br />OF SAN MARCOS CODE OF ORDINANCES, TO ADD A DEFINITION (CONSTRUCTION <br />NOISE); INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and <br />Ms. Narvaiz seconded the motion. Mr. Mark Taylor stated the Construction <br />Noise definition was accidentally left out of the Code. The Council then <br />voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />EXPRESSING SUPPORT FOR PRESIDENT GEORGE W.
