1.4.11 Notifications and Disposal Site Reports <br /> <br /> A. Tile Contractor will notify ail customers of complaint pmcedul'es, regulations, and days for <br />scheduled residential solid waste and recyclable materials collection. <br /> <br /> B. Tile Contractor will forward to tile City at its request, copies of all Texas Commission on <br />Environmental Quality Inspection Reports for the sites being used for the disposal of solid waste or <br />recyclable materials collected under tbis Contract. <br /> <br />1.4.12 Interruption of Service <br /> <br />Ill the event the collection and disposal of solid waste or recyclable materials is interrupted for any reason <br />within tile Contractor's reasonable control for more than 48 bouts, tile City will have tile rigbt to make <br />temporary independent arrangemeuts for coutinuing these services to its citizens to provide and protect <br />the public bealtb and safety. In the event of this type of interruption, the Contractor will bear all expeuses <br />incurred for collection and disposal. Notwithstanding any other provision of this Contract, if an <br />interruption in service continues for a period of ten days, the City will bave the rigbt to immediately <br />terminate tbis Contract and to seek any remedy provided by law. <br /> <br />1.4.13 Natural Disaster <br /> <br />In the case of excessive amounts of solid waste caused by a tornado, severe storm, high winds, flooding, <br />hurricane, ice storm or other similar natural occurrence or act of God, the City may dispose of the solid <br />waste in whatever manner it may elect; provided however, that the City will attempt in good faitb to use <br />the Contractor's services if they can be used at the same or lower cost than other methods available to tbe <br />City. <br /> <br />1.4.14 Place of Collection <br /> <br />The Contractor will perform all normal residential solid waste and recyclable materials collection <br />activities at curbside, or with permission of the Director, from an alley. <br /> <br />1.4.15 Miscellaueous <br /> <br /> A. The Contractor wilI discontinue collection services at any residential nnit as set forth iu a <br />written notice sent to it by the City. Upon fi~rtber notification by t!le City, the Contractor will resume <br />collection on tbe next regnlarly scheduled collection day. To tbe extent of the City's liability under <br />applicable law, the City will indemnify and bold the Contractor harmless from any claims, suits, damages, <br />liabilities or expenses resulting from the Contractor discoutinuing service at any location at the direction <br />of the City. <br /> <br /> B. Tile Contractor's right to provide collection aud disposal services for solid waste and recyclable <br />materials from within the contract area shall apply only to matters specifically addressed in this Contract. <br />The City will nse its best efforts to require customers to comply with ordinances providing for curbside <br />placement of residential solid waste for collection by the Contractor. <br /> <br />Section 1.5 Education Program <br /> <br />1.5.1 Tbe Contractor will be an integral part of a continuing City service to which the residents are <br />accustomed, and will provide a high level of cooperation with the City and its citizens iu carrying out the <br />services specified in this Contract. <br /> <br />11 <br /> <br /> <br />
