Section 2.5 <br /> <br />The City will serve as the customer contact for initiation of residential unit service, and will relay service <br />initiation requests to the Contractor. <br /> <br />ARTICLE 3 <br />PAYMENTS <br /> <br />Section 3.1 Rates and Billing <br /> <br />3.1.1 The Contractor will hill the City for service rendered to residential nnits during a month withiu teu <br />calendar days following the end of the month, and the City will pay the Contractor on or before the 30th <br />day following the date of each bill. Payments after the 30~h day will accrue interest at 1.5% per month, or <br />the maxiinum interest rate allowed by law, whichever is less. Such hilling and payment will be based on <br />the price rates and schedules set Forth in subsection 3.1.3 of this Contract. <br /> <br />3.1.2 Tbe rate charged by the Contractor will be as follows: <br /> <br />$12.35 per msideotial unit per month <br /> <br />Section 3.2 Calcnlation of Payments for Residential Units <br /> <br />3.2.1 Payment for each mouth's service will be determined by applying the contract unit price for <br />collections to the actnal number of occupied residential dwelling units within the contract area during the <br />immediately preceding month as shown by the City's utility billing records. <br /> <br />3.2.2 New acconnts added after the first day of a month will be counted as having received service for a <br />frill month. Accoants discontiaued during a given month will be counted as not having received service <br />For that month, as determined by the above described reports. <br /> <br />3.2.3 If the Contractor disagrees with the City's records in the number of uuits serviced for a given <br />month, the Contractor will specify the nature of the disagreement, the address(es) of the unit(s) in <br />qnestion, the type of service being provided, and the date such service began or ended. The Director will <br />investigate reported discrepancies and confirm or deny tbe Contractor's request. The Director will decide <br />the issue in a fair and reasonable manner, and the Director's decision will be final. The Contractor wilI <br />continue to provide collection services pending resolution of disputes. <br /> <br />3.2.4 The Contractor may request in writing that payments due or to become due to it be assigned to a <br />bank or other financing institution, provided that prior written approval is obtained through the City <br />Manager, and payment by the City is made only to one party. Any assignment not in conformance with <br />this provision will be null and void as to the City. A fee of $100.00 per contract, per request, will be <br />charged to the Contractor for administrative costs in processing each assignment under this paragraph. <br />Upon paymeut of such fee to the City, contract payments will he modified to reflect the cbanged payee <br />name and address. <br /> <br />Section 3.3 Modification of Rates <br /> <br />3.3.1 The rate charged by the Coutractor tbr the second and subsequent years of the contract term may <br />be adjusted upward or downward to reflect tbe net pereentage change from the previous year in the <br />Consumer Price Index for Urbao Wage Earners and ClericaI Workers (all items), and the Consumer Price <br /> <br />13 <br /> <br /> <br />
