The CITY OF SAN MARCOS shall <br />administer a program of maintenance, repair, and protection of assets under this Contract <br />so as to assure their full availability and usefulness. In the event the CITY OF SAN <br />MARCOS is indemnified, reimbursed, or otherwise compensated for any loss of, <br />destruction of, or damage to the assets provided under this Contract, it shall use the <br />proceeds to repair or replace said assets. <br />j. Controlling all equipment by the requirements of Uniform Grants Management Standards <br />(UGMS). If, prior to the end of the useful life, any item of equipment is no longer needed <br />to perform services under this Contract, or becomes inoperable, or if the equipment <br />requires licensure or registration or had an acquisition price equal to or greater than <br />$5,000, the CITY OF SAN MARCOS shall request disposition approval and instructions <br />in writing from the DSHS Contract manager assigned to the Contract. After an item <br />reaches the end of its useful life, the CITY OF SAN MARCOS shall ensure that <br />disposition of any equipment is in accordance with Generally Accepted Accounting <br />Principles, and any applicable federal guidance. <br />k. Notwithstanding the foregoing provisions, at any time, the CITY OF SAN MARCOS <br />may, in its sole discretion, determine to discontinue fluoridation. If the CITY OF SAN <br />MARCOS determines to discontinue fluoridation, its obligation hereunder shall be to <br />notify DSHS Fluoridation Project of its decision within thirty (30) days; and arrange for <br />transfer or disposal at no cost to the DSHS of all fluoridation equipment provided <br />hereunder. Thereafter, the CITY OF SAN MARCOS shall have no further obligations <br />hereunder, including, no obligations to operate the fluoridation equipment, perform onsite <br />monitoring of fluoride level, or submit water samples for fluoride -level analysis. <br />L Activities shall be performed and reports submitted in accordance with the following: <br />• "Engineering and Administrative Recommendations for Water Fluoridation, 1995," <br />Centers for Disease Control and Prevention (CDC) Publication, Morbidity and <br />Mortality Weekly Report, Volume 44, No. RR -13. which is adopted by reference as a <br />part of this Contract. <br />• Installation instructions and maintenance requirements outlined in the vendor <br />specifications included with the equipment. <br />4. Roles and Responsibilities of Both Parties <br />a. The CITY OF SAN MARCOS and DSHS, by signing this Contract, do certify that: <br />1) this Contract is authorized by the governing body of each party; and <br />2) each party paying for the performance of governmental functions or services is <br />making those payments from current revenues available to the paying party. <br />b. The Parties will furnish detailed information, subject to confidentiality requirements, as <br />required by the other Party to render the performances called for in this Contract. Each <br />Party will provide the other Party access to, and free copies of, any records or <br />information relevant to this Contract that is kept by the Party or its Contractors. <br />5.
