The CITY OF SAN MARCOS shall administer a program of maintenance, repair, and protection of assets under this Contract so as to assure their full availability and usefulness. In the event the CITY OF SAN MARCOS is indemnified, reimbursed, or otherwise compensated for any loss of, destruction of, or damage to the assets provided under this Contract, it shall use the proceeds to repair or replace said assets. j. Controlling all equipment by the requirements of Uniform Grants Management Standards (UGMS). If, prior to the end of the useful life, any item of equipment is no longer needed to perform services under this Contract, or becomes inoperable, or if the equipment requires licensure or registration or had an acquisition price equal to or greater than $5,000, the CITY OF SAN MARCOS shall request disposition approval and instructions in writing from the DSHS Contract manager assigned to the Contract. After an item reaches the end of its useful life, the CITY OF SAN MARCOS shall ensure that disposition of any equipment is in accordance with Generally Accepted Accounting Principles, and any applicable federal guidance. k. Notwithstanding the foregoing provisions, at any time, the CITY OF SAN MARCOS may, in its sole discretion, determine to discontinue fluoridation. If the CITY OF SAN MARCOS determines to discontinue fluoridation, its obligation hereunder shall be to notify DSHS Fluoridation Project of its decision within thirty (30) days; and arrange for transfer or disposal at no cost to the DSHS of all fluoridation equipment provided hereunder. Thereafter, the CITY OF SAN MARCOS shall have no further obligations hereunder, including, no obligations to operate the fluoridation equipment, perform onsite monitoring of fluoride level, or submit water samples for fluoride -level analysis. L Activities shall be performed and reports submitted in accordance with the following: • "Engineering and Administrative Recommendations for Water Fluoridation, 1995," Centers for Disease Control and Prevention (CDC) Publication, Morbidity and Mortality Weekly Report, Volume 44, No. RR -13. which is adopted by reference as a part of this Contract. • Installation instructions and maintenance requirements outlined in the vendor specifications included with the equipment. 4. Roles and Responsibilities of Both Parties a. The CITY OF SAN MARCOS and DSHS, by signing this Contract, do certify that: 1) this Contract is authorized by the governing body of each party; and 2) each party paying for the performance of governmental functions or services is making those payments from current revenues available to the paying party. b. The Parties will furnish detailed information, subject to confidentiality requirements, as required by the other Party to render the performances called for in this Contract. Each Party will provide the other Party access to, and free copies of, any records or information relevant to this Contract that is kept by the Party or its Contractors. 5. Term of the Contract -3-
