Regular Meeting April 28, 2003 Page 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 66, SOLID WASTE, OF THE CITY CODE TO PROVIDE FOR A <br />FEE TO BE CHARGED TO ALL RESIDENCES FOR RECYCLING CENTER SERVICES; <br />SETTING THE AMOUNT OF THE FEE; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Habingreither closed the public hearing. <br />M~. Mayhew moved for approval of the Ordinance on first reading and Ms. <br />Narvaiz seconded the motion. Mr. 0'Leary stated a recycling drop off <br />service is provided to all San Marcos citizens, but the Single-Family <br />residents have been paying for these services. This amendment will <br />spread the cost of the recycling drop off service to include Multi-Family <br />units. Mr. O'Leary also stated this amendment will reduce the cost the <br />Single-Family residents were paying. The Council then voted unanimously <br />for approval of Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE SALE OF A FORMER WELL SITE IN GREEN HAVEN ESTATES, <br />BETWEEN 226 AND 304 BOOTH DRIVE, TO EDWARD P. GREEN AND MARILYN I. <br />GREEN, AND TO TIMOTHY ELLISON AND SANDRA ELLISON; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE SPECIAL WARRANTY DEEDS; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading and Mr. <br />Mayhew seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 6, HOST RESPONSIBILITIES OF PARTIES IN RESIDENTIAL <br />AREAS, OF CHAPTER 34, ENVIRONMENT, OF THE SAN MARCOS CITY CODE, TO <br />CLARIFY AND CORRECT TERMINOLOGY; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading and Ms. <br />Narvaiz seconded the motion. Jan Clark, Assistant City Attorney, stated <br />this Ordinance is to amend some of the definitions such as ~unlawful <br />level of noise", and changes for grammatical correctness or legal <br />sufficiency. She stated these changes will help with the implementation <br />and enforcement of the current Ordinances. Mayor Habingreither inquired <br />why the City does not use decimal meters. Mr. O'Leary stated the City did <br />use decimal meters at one time. Mr. Taylor stated he is concerned with <br />the use of ~unlawful level of noise" and feels the definition is <br />subjective. Mr. Mark Taylor stated the Officer is the person charging the <br />violator with unreasonable noise, and this is left up to their discretion. <br /> <br /> <br />
