The Council then voted unanimously for approval of the Ordinance on second reading. Mayor Pro-Tem Mayhew introduced for consideration Item 17 removed from the consent agenda, approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE ABANDONMENT OF THE 500 BLOCK OF NORTH FREDERICKSBURG STREET; APPROVING THE CONVEYANCE OF THIS TRACT TO SOUTHWEST TEXAS STATE UNIVERSITY AND AMERICAN CAMPUS (SWT II) LTD; AUTHORIZING THE CiTY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. Ms. Narvaiz moved for approval of the Ordinance on second reading and Mr. Taylor seconded the motion. Mr. O'Leary stated he had met with Southwest Texas State University and the developers. He expressed the concerns of the Council wanting the University to develop the property, as other developers are required to do. He stated Southwest Texas State University seems to be willing to work with the developers. On roll call the following vote was recorded: AYE: Montoya, Narvaiz, Taylor and Mayhew. NAY: None. ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business entity filed with City Clerk). Mayor Habingreither introduced for consideration Item 20 removed from the consent agenda, adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE CITY OF SAN MARCOS CODE OF ORDINANCES TO ADD A DEFINITION; INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND PROVIDING AN EFFECTIVE DATE. Mr. Mihalkanin moved for adoption of the Ordinance on third and final reading and Mr. Taylor seconded the motion. Mr. Taylor moved to amend Section 14.0ii(b) and (c) to change the hours to read ...between midnight and 7:00 a.m. and Mr. Mihalkanin seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Ordinance on third and final reading.
