Regular Meeting <br /> <br />AYE: Montoya, <br /> <br /> April 28, 2003 <br /> <br />Narvaiz, Habingreither and Taylor. <br /> <br /> 13. <br />Page 9 <br /> <br />NAY: <br /> <br />Mihalkanin and Mayhew. <br /> <br />ABSTAIN: None. <br /> <br />The Council then voted unanimously for approval of the Ordinance on second <br />reading. <br /> <br />Mayor Pro-Tem Mayhew introduced for consideration Item 17 removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE ABANDONMENT OF THE 500 BLOCK OF NORTH FREDERICKSBURG <br />STREET; APPROVING THE CONVEYANCE OF THIS TRACT TO SOUTHWEST TEXAS <br />STATE UNIVERSITY AND AMERICAN CAMPUS (SWT II) LTD; AUTHORIZING THE <br />CiTY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on second reading and Mr. <br />Taylor seconded the motion. Mr. O'Leary stated he had met with Southwest <br />Texas State University and the developers. He expressed the concerns of <br />the Council wanting the University to develop the property, as other <br />developers are required to do. He stated Southwest Texas State <br />University seems to be willing to work with the developers. On roll call <br />the following vote was recorded: <br /> <br />AYE: Montoya, Narvaiz, Taylor and Mayhew. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business <br /> entity filed with City Clerk). <br /> <br />Mayor Habingreither introduced for consideration Item 20 removed from the <br />consent agenda, adoption of an Ordinance on third and final reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE CITY <br />OF SAN MARCOS CODE OF ORDINANCES TO ADD A DEFINITION; INCLUDING <br />PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on third and final <br />reading and Mr. Taylor seconded the motion. Mr. Taylor moved to amend <br />Section 14.0ii(b) and (c) to change the hours to read ...between midnight <br />and 7:00 a.m. and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. The Council then voted unanimously for adoption of the <br />Ordinance on third and final reading. <br /> <br /> <br />
