<br /> and will make a written recommendation to the City regarding City's acceptance of the <br /> Project. <br /> 1.5.17 Interpret and decide matters concerning performance of the City and Contractor <br /> under, and requir~ments of, the Contract Documents on written request of either the City <br /> or Contractor. The Consultant's response to these requests will be made in writing with <br /> reasonable promptness. Interpretations and decisions of the Consultant will be consistent <br /> with the intent of and reasonably inferable from the Contract Documents and will be in <br /> writing or in the form of drawings. The Consultant will render initial decisions on claims, <br /> disputes or other matters in question between the City and Contractor as provided in the <br /> Contract Documents. However, the Consultant's decision on matters relating to aesthetic <br /> effect will be final if consistent with the intent expressed in the Contract Documents. <br /> 1.5.18 Require the submission by the Contractor, and subcontractors performing work on <br /> the Project site, of periodic wage rate payment reports and, with the City's assistance, <br /> verify compliance with federal and state wage rate requirements for the Project; and notify <br /> the City of any noncompliance, or of the failure by the Contractor or subcontractor's to <br /> make submissions. <br /> 1.5.19 Prepare, or cause to be prepared, and submit to the City a set of reproducible <br /> record drawings showing significant changes in the work made during the construction <br /> phase. <br /> 1.5.20 Ensure that all notices and signs required and provided by HUD are posted in the <br /> appropriate locations at the Project site. <br /> 1.5.21 Conduct the final inspection with the City to check conformance of the Project with <br /> the requirements of the contract documents and to verify the accuracy and completeness <br /> of the list submitted by the Contractor of work to be completed or corrected and to prepare <br /> a punch list prior to final acceptance by the City. <br /> 1.5.22 When the Project is found to be substantially complete, the Consultant will inform <br /> the City about the balance of the Contract Sum remaining to be paid the Contractor, <br /> including any amounts needed to pay for final completion or correction of the Project. <br /> 1.5.23 Receive from the Contractor and forward to the City: (1) consent of surety or <br /> sureties, if any, to reduction in or partial release of retainage or the making of final payment <br /> and (2) affidavits, receipts, releases and waivers of liens or bonds indemnifying the City <br /> against liens. <br /> 1.5.24 Prior to the end of the one year warranty period, review the completed Project with <br /> the City and the Contractor and have all deficient items corrected. The extent of the duties, <br /> responsibilities and limitations of authority of the Consultant as the City's representative <br /> during construction will not be modified or extended after the construction contract <br /> documents have been authorized by the City to be competitively bid without written consent <br /> 10 <br />
