<br /> number of gallons of Sludge loaded, handled, hauled and disposed of during the <br /> immediately preceding month. Contractor's invoicing for the Services will be done on a <br /> monthly basis. The billing format will be developed and mutually agreed to by the <br /> Contractor and the City of San Marcos. <br /> a. The actual number of gallons of Sludge will be determined by a flow meter <br /> in the 4" line to which the Sludge hauling truck connects. <br /> b. Contractor will provide a duplicate type loading ticket each time a truck is <br /> loaded with Sludge. This ticket will include at a minimum the following <br /> information: <br /> (1) Contractor's name, address, phone/fax numbers, business <br /> logo, etc. <br /> (2) ticket or invoice number for tracking and billing purposes <br /> (3) the truck identification number <br /> (4) the date the Sludge was loaded <br /> (5) type of Sludge hauled (Class A or Class B) <br /> (6) the disposal site the Sludge will be hauled to <br /> (7) the number of gallons loaded <br /> (8) two signature lines <br /> Each ticket will be filled out when a truck is loaded and then signed by the <br /> Contractor's authorized representative and an authorized member of the <br /> City's W\NTP staff verifying that all information on the ticket is correct. A <br /> copy of the ticket will be provided to the W\NTP staff member upon <br /> execution. <br /> c. The loading tickets will be the basis for determining the number of <br /> gallons of Sludge loaded, handled, hauled and disposed of during the <br /> previous month. <br /> d. If there is a dispute with the City's records regarding service during a <br /> given month, the Contractor will specify the nature of the <br /> disagreement and the date and time the subject service was <br /> performed. The City will investigate reported discrepancies and <br /> confirm or deny the Contractor's requests. The City's decision will be <br /> final. The Contractor will continue to provide the Services until the <br /> problem is resolved. <br /> 3.3 MODIFICATION OF RATES <br /> 3.3.1 The Contractor may petition the City for rate and price adjustments at reasonable <br /> times (other than at option-to-renew periods) based on increases in cost of operations, <br /> such as revised laws, ordinances, regulations, changes in disposal sites, disposal costs, <br /> 9 <br />
