<br /> or lower cost than other methods available to the City; and provided, further, that the cost <br /> of collection during disaster cleanups will be limited to actual cost to the Contractor plus <br /> ten percent (10%). <br /> Place of Loading <br /> <br /> 1.4.23 The Contractor will load the Sludge at the City's \NVVTP. The Contractor will <br /> provide equipment having the capability to pump the holding tank contents into its hauling <br /> vehicles. <br /> Access To Disposal Site <br /> <br /> 1.4.24 The Contractor will be responsible for provid ing or improving means of access to <br /> each disposal site including roads, culverts, gates, etc., where necessary to allow for <br /> Contractor equipment traffic. The Contractor will submit the layout of, and construction <br /> materials and methods for all proposed disposal site improvements deemed necessary by <br /> the Contractor to the City for its approval. Any improvement work being proposed will be <br /> subject to City approval prior to being performed. <br /> Miscellaneous <br /> <br /> 1.4.25 Subject to subsections 1.4.20 and 1.4.22, the Contractor will have sole and <br /> exclusive right to load, haul, handle and dispose of Sludge from the City's \NVVTP. The <br /> City has the right to remove varying quantities of the Sludge with its own equipment for <br /> other uses'such as dewatering at the \NVVTP or for land application at City owned facilities <br /> such as parks, athletic complexes and composting sites. <br /> 1.4.26 In the event the Contractor does not perform its Services in accordance with the <br /> stipulations set forth in this Contract, the City may seek other methods of having the <br /> Sludge removed, handled and disposed of from the \NVVTP. In the event the City uses an <br /> alternative method for the removal, hauling and disposal of the Sludge, the City, in its sole <br /> discretion, may charge to the Contractor either 1) liquidated damages in the amount of <br /> $0.25 per of gallon of Sludge, or 2) the actual cost of removal, hauling and disposal of the <br /> Sludge. <br /> ARTICLE 2 <br /> THE CITY'S RESPONSIBILITIES <br /> The City will: <br /> 2.1 Provide full information to the Contractor regarding the City's requirements for the <br /> Contractor's services under this Contract. The City will furnish the Contractor with copies <br /> of data and information in the City's possession needed by the Contractor at the <br /> Contractor's request. <br /> 7 <br /> 8' <br />
