<br /> 146 <br /> INTERLOCAL AGREEMENT FOR FIRE PROTECTION SERVICES <br /> This Interlocal Agreement is made and entered into this 13th day of October, 1998, by <br /> and between the City of San Marcos, Texas (the "City"), a municipal corporation organized and <br /> existing under the laws of the State of Texas, and the South Hays County Emergency Services <br /> District #3 (the "District"), an emergency services district operating in a geographical area of <br /> South Hays County, Texas, duly created and organized under the laws of the State of Texas. <br /> ARTICLE I. <br /> 1.01 The purpose of this Agreement is to secure to the residents of the City of San Marcos, <br /> Texas, and to the residents of the South Hays County Emergency Services District #3, Hays <br /> County, Texas, the protection of life and property from fire. <br /> ARTICLE II. <br /> 2.01 In the event of a fire or fires, within the geographical area of the District, upon request <br /> to the Chief of Police, Fire Chief or, in their absence the on duty Shift Captain, of the San Marcos <br /> Fire Department, firefighting equipment, if available and in good working order, and personnel, <br /> if available, of the San Marcos Fire Department win be dispatched to any point within the <br /> geographical area of South Hays County Emergency Services District #3, pursuant to this <br /> Agreement. <br /> ARTICLE m. <br /> 3.01 The South Hays County Emergency Services District #3 agrees to indemnify and hold <br /> harmless the City, its employees and Fire Department volunteers, for any loss, damage, personal <br /> injury, or death occurring as a result of the negligence of the City or these personnel in carrying <br /> out services under this Agreement, regardless of whether such loss, damage, personal injury, or <br /> death is caused in whole or in part by the negligence of the City, its employees or Fire <br /> Department volunteers. <br /> 1 <br />
