89. <br />Regular Meeting May 28, 2003 Page 9 <br /> <br />MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution and Mr. Taylor seconded <br />the motion. Mr. O'Leary stated the Professional Services Agreement covers <br />the preparation of a Water Supply Master Plan to ensure the City's <br />drinking water for the next 50 years. He stated Turner, Collie and Braden <br />were selected for this project because of their expertise in State Water <br />Planning, their ability to communicate complex issues clearly and their <br />experience in water availability modeling, both surface and ground water <br />sources. Mr. Taylor inquired to the amount of the contract. Ms. <br />Anderson stated there is a cost breakdown attached to the agreement and <br />when a Master Plan is involved, the cost is always higher. She stated the <br />City is paying for Turner, Collie and Braden's expertise. Ms. Narvaiz <br />stated she feels it is not only important to secure future water, but also <br />to take a regional look at the water supply around us. The Council then <br />voted unanimously for the adoption of Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 27, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A DEVELOPMENT AGREEMENT BETWEEN <br />THE CITY AND VISION LAND GROUP CONCERNING THE PROPOSED COTTONWOOD <br />CREEK DEVELOPMENT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution and Mr. Taylor seconded <br />the motion. Mayor Habingreither asked Mr. O'Leary to explain this <br />project, since there are two new Council Members. Mr. O'Leary stated <br />there is a large development on Highway 123 South named Cottonwood Creek. <br />He stated this area has been identified as a preferred growth area of the <br />City, but significant water and wastewater facility improvements will be <br />needed to serve the area. The City has been negotiating a development <br />agreement with Mr. Morris over several months. He stated the developer <br />will donate a site for a new elevated water storage tank to the City, <br />approximately 67 acres of parkland and greenspace, a site for a new <br />elementary school and a new intermediate school. Mr. Morris will also <br />pursue the establishment of a satellite higher education campus and donate <br />a site for the campus. Mr. O'Leary stated Mr. Morris will bear the cost <br />of all on-site infrastructure and 75% of the cost of off-site water and <br />wastewater lines to serve the development. The City will bear 25% of the <br />cost of off-site water and wastewater lines and 100% of the cost of <br />oversizing the lines. He also stated the City will reserve capacity in <br />the off-site water and wastewater lines, and the developer will be charged <br />~'grandfathered" water and wastewater impact fee amounts for 50% of the <br />service units needed for buildout of the development. Mr. O'Leary also <br />stated the City's participation in the extension and oversize for both <br />water and wastewater will come from impact fees. Currently there is <br /> <br /> <br />
