Regular Meeting April 17, 2007 Page 9 Mayor Narvaiz introduced for consideration Item 21, removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDED LEASE AGREEMENT BETWEEN THE CITY AND THE SAN MARCOS LIONS CLUB FOR THE LEASE OF PORTIONS OF THE RECREATION BUILDING IN CITY PARK, AND TO ALLOW OPERATION OF A CONCESSION STAND IN RIO VISTA PARK; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. Mr. Guerrero moved for adoption of the Resolution, and Mr. Thomaides seconded the motion. Mr. O'Leary stated this Resolution is for the amendment to the lease to add a concession stand in the Rio Vista Park. He stated this lease will be extended for an additional five years. He stated the Lions Club will give the City 750 of the profits from those sales in return for the exclusive right to sell concessions at City and Rio Vista Parks. This payment is far in excess of any payment that has been offered through competitive bid processes, so staff accepted the offer in the best interests of the City. Mr. Thomaides thanked Staff for working concessions lease and getting the best lease for the City. He requested that the Lions Club use river friendly packaging, which is not harmful to river life. Cody Dailey, President of Lions Club, stated the Tube Rental Committee is meeting tomorrow to discuss this request. The Council then voted unanimously for the adoption of the Resolution. Mayor Narvaiz introduced for consideration Item 24, removed from the consent agenda, approval to solicit bids for the purchase of City owned property located at 300 Ellis. Mr. Guerrero moved for the approval to solicit bids for the purchase of City owned property located at 300 Ellis, and Ms. Couch seconded the motion. Mr. O'Leary stated the City has received a request to purchase this lot. In accordance with City policy all city departments have been asked for comments or concerns and none have indicated a concern. He stated pursuant to the Local Government Code the property must be sold via a bid process. Mayor Narvaiz inquired to whether this property can be used for affordable housing. Mr. Quittner stated this property can be used for affordable housing, the approval will need to be amended. Mr. Robertson moved to amend the approval to read ... lot available to affordable housing, and Ms. Couch seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Resolution. Mayor Narvaiz introduced a public hearing regarding the Fiscal Year 2007- 2008 Budget Policy. Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. O'Leary stated this is the beginning stage of the Budget. He stated there will be several opportunities for citizens to come in and speak to the Council.
