<br /> shorter, in which to repair the damage to a condition <br /> suitable to Lessee!s purposes or to require the expenditure <br /> of a sum of money exceeding the contributory value of the <br /> improvements prior to such casualty or damage, then either <br /> party may terminate this lease agreement upon giving the <br /> other party a thirty (30) day written notice of such <br /> termination. <br /> 11. ASSIGNMENT AND SUBLETTING: <br /> a} Lessee may not assign this lease or sublet the <br /> leased premises, or any part thereof, except upon the prior <br /> written consent of the Lessor. No assignment or sublease by <br /> Lessee shall affect a release of any of Lessee!s obligations <br /> under this lease. <br /> b) In the event of a transfer or assignment by <br /> the Lessor of its interest in this lease and/or in the <br /> leased premises to a person, firm or corporation which <br /> assumes the Lessor!s obligations under this lease, the <br /> Lessor shall be released from further obligations and the <br /> Lessee agrees to look solely to the successor in interest of <br /> the Lessor to enforce its rights and interests under this <br /> lease or applicable law subject to receipt of a thirty (30) <br /> day written notice delivered to Lessee of said change in <br /> Lessor's interest that clearly indicates the name, address, <br /> and telephone number of the party to whom rental payments <br /> are to be made together with sufficient proof of the <br /> transfer or assignment. <br /> 12. MAINTENANCE AND REPAIRS: <br /> a) Lessor agrees to keep and maintain the leased <br /> premises in good repair including, but limited to the roof, <br /> walls and foundation of the building, and agrees to keep the <br /> building in a structurally sound and weather tight <br /> condition. <br /> b) Lessee agrees to take good care of the leased <br /> premises and to return the leased premises in good <br /> condition, reasonable wear and tear, loss by fire or other <br /> casualty excepted. <br /> c) Lessee agrees to take good care of the outside <br /> of the leased premises, including the common spaces. <br /> d) Lessee agrees to take care of all day-to-day <br /> maintenance of the leased premises. <br /> Page 3 of 6 <br />
