Amend the last sentence of Section 9.01 as follows: <br /> - In no event, however, shall revenue bonds be considered aft genera" indebtedness <br /> of the city nor repaid with funds secured by taxation. <br /> ... <br /> This change clarifies the special nature of the City's revenue bonds. While they are debts <br /> of the City, only the City's utility revenues are pledged to repay them. <br /> 11. Amend Section 11.01. Section 11.07(d) and (t). and Section 11.08 regarding public <br /> utility franchises as follows: <br /> Sec. 11.01. Powers of the city council. <br /> The city council has the following powers regarding public utilities of every <br /> character operating in the city: <br /> , <br /> (1) To buy, condemn, construct, lease, maintain and operate public utility systems <br /> in the city; <br /> (2) To sell, manufacture and distribute tþe services and output of city public utility <br /> systems; <br /> (3) To prohibit the use of city streets, alleys, easements or other grounds by a <br /> public utility unless the utility first obtains a franchise in accordance with this <br /> article; and <br /> (4) To regulate public utilities in the interest of public health, welfare and safety. <br /> In addition to the city's po'J'Í'er to buy, construct, lease, maintain, operate, and <br /> regulate public utilities and to manufacture, distribute, and sell the oL;1tput of such <br /> utility operations, the city shall have such further power3 a3 may nm... or thereafter <br /> be granted under the con3titution and lal/;s of thc State of Texas. <br /> Section 11.07. Right of regulation. <br /> (d) To impose regulations to ensure safe, efficient and continuous service to the <br /> public.
