<br /> }JD <br /> -5- <br /> The council has authority to supervise and regulate the operations of city <br /> owned utilities, including the following: <br /> (a) To establish the rates, terms and conditions for the sale of utility <br /> services. <br /> r -- (b) To prescribe rules and standards for the construction, extension, <br /> maintenance and operation of production, transmission and <br /> distribution facilities. <br /> The Council may exercise this authority itself, or it may delegate all or part of <br /> the authority to a board of citizens to oversee one or more of the city's utilities. <br /> MEASURE NO. 12 <br /> SHALL THE CITY COUNCIL BE AUTHORIZED TO LEASE THE SOCCER <br /> COMPLEX, A 9.48 ACRE AREA OF PARKLAND AT GARY PARK TO THE <br /> SAN MARCOS YOUTH SOCCER ASSOCIATION UNDER TERMS <br /> SUMMARIZED AS FOLLOWS: <br /> . <br /> 1. Term: 5 years, with two 5-year renewal options subject to City Council <br /> approval. <br /> 2. Rights granted: Exclusive right to Concession Building; right of first priority <br /> to use remainder of Complex from September 1 st to December 31 st each <br /> year. <br /> , 3. Maintenance: utilities: Soccer Association maintains grounds from <br /> September-December; City maintains the rest of the year; City provides <br /> water, sewer and electricity. <br /> 4. Nondiscrimination: Soccer Association is not to discriminate on basis of <br /> religion, race, sex, disability or national origin. <br /> 5. Insurance and indemnity: Soccer Association will maint?in liability <br /> insurance, and will indemnify City for claims and losses connected with <br /> Soccer Association's use of Complex. <br /> 6. Termination: Soccer Association can terminate with six months notice; City <br /> can terminate for default with 60 days notice; City can terminate for any <br /> reason with 18 months notice, with City to reimburse Association for <br /> permanent improvements at 75% of appraised value during first 5-year <br /> term, 50% of appraised value during second 5-year term and no <br /> reimbursement during third 5-year term. <br /> SECTION 3. That the ballots for the City election will conform to the requirements <br /> of the Texas Election Code, and will have the measures described in Section 2 of this <br /> Ordinance stated as propositions as follows: <br /> PROPOSITION NO.1 <br /> FOR/AGAINST The amendment of Section 3.02(a)(4) of the City Charter, <br /> regarding qualifications for serving on the city council, to <br /> simplify the current wording and to ensure uniform terminology <br /> in the Charter. <br />
