<br />/oJA- <br /> <br /> <br />to Lessor a monthly fuel flowage fee equal to two percent (2%) of the retail value <br />of all fuel used at the Airport by Lessee which is not purchased from an authorized <br />Airport fuel vendor. Fuel flowage fee is to be paid within ten (10) days of the last <br />day of the previous month and shall be based on the fuel usage during the previous <br />month. <br /> <br />I 2.5 As further consideration and rental for the Leased Premises, Lessee agrees to pay <br />to Lessor a monthly fee for the use of tie-down facilities for aircraft under the <br />- custody and control of the Lessee or any employees, agents or customers of the <br />Lessee. <br /> <br />2.6 Lessee shall provide to Lessor any business records reasonably necessary, as <br />deemed by Lessor, to verify amount of said fees. Should the commencement or <br />termination of this Lease take effect on other than the first day of a month, all rents <br />and fees payable by Lessee under this Lease shall be prorated accordingly. <br /> <br />2.7 Lessor agrees that all airport revenue derived from Lessee and any other use of the <br />property shall be allocated toward the maintenance of the Airport and <br />improvements; provided, however, that this requirement shall not be considered <br />mandatory upon Lessor unless it is so required by existing indenture or agreement <br />with the Federal Government or any amended or substitute indentures and <br />agreements entered into with the Federal Government. . <br /> <br />ARTICLE III <br />Use and Care of Premises <br /> <br />3.1 The uses of the premises by Lessee shall be restricted to those connected with <br />aviation purposes or aviation-related purposes, except for uses allowed by written <br />agreement. Specifically, the Leased Premises shall be used and occupied only for <br />~ the purpose of operating a specialized flight school providing rides and training in <br />World War II aircraft, and for no other purpqses without the prior written consent of <br />Lessor. Lessee shall not at any time leave the Leased Premises vacant, but shall <br />in good faith continuously throughout the term of this Lease conduct and carry on <br />in the Leased Premises the type of business for which the Leased Premises are <br />leased, and shall keep the Leased Premises open to the public for business during <br />normal business hours. <br /> <br />3.2 Lessee shall not, without Lessor's prior written consent, keep anything within the <br />Leased Premises or use the Leased Premises for any purpose which increases the <br />insurance premium cost or invalidates any insurance policy carried on the Leased <br />Premises. All property kept, stored or maintained within the Leased Premises by <br />Lessee shall be at Lessee's sole risk. <br /> <br />3.3 Lessee shall not, without Lessor's prior written consent, conduct within the Leased <br />Premises any objectionable activity, nor permit any objectionable or unpleasant <br />odors to emanate from the premises; nor take any other action which would disturb <br />or endanger the public. <br /> <br />3.4 Lessee shall take good care of the Leased Premises and keep it free from waste <br />at all times. Lessee shall keep the Leased Premises, including ramps, signs, <br />sidewalks, serviceways, and loading areas adjacent to the premises neat, clean, <br />and free from dirt or rubbish at all times, and shall store all trash and garbage within <br />the Leased Premises, arranging for the regular pick-up of such garbage at Lessee's <br />expense. <br /> <br />3.5 During the term of this Lease, Lessor agrees that Lessee shall have the <br />unrestricted access to the runways, taxi-ways and ramp now in existence at the <br />Airport to the same extent that any other parties may have use. It is understood <br />and agreed by and between the parties that the continuing use of the Airport as an <br />airport for general aviation is essential to the operation of Lessee and that failure <br />
