<br /> (0'713 <br /> to continue the use of the Airport for airport and aviation purposes shall constitute <br /> a default in the Lease and upon giving notice by Lessee to Lessor of such default <br /> and failure to cure default within five (5) days after the giving of notice, this Lease <br /> shall terminate and end as of the date 10 days after notice shall have been given; <br /> and Lessee shall be released from and relieved of all further obligations. <br /> ARTICLE IV <br /> Maintenance and Repair of Premises <br /> 4.1 Lessee shall keep the Leased Premises in good, clean condition and shall make <br /> all needed repairs, including but not limited to the foundation, exterior walls and <br /> roof. Lessee shall comply, at its sole cost and expense, with all governmental laws, <br /> ordinances and regulations applicable to the Leased Premises, except that Lessee <br /> shall not be obligated to make any structural changes or alterations to the Leased <br /> Premises unless made necessary by the act or omission of the Lessee, in which <br /> event Lessee shall comply, at its expense, with plans and specifications approved <br /> by Lessor. If any repairs required to be made by Lessee are not made within 10 <br /> days after written notice delivered to Lessee by Lessor, Lessor may at its option <br /> make repairs without liability to Lessee for any loss or damage which may result to <br /> its stock or business by reason of the repairs, and Lessee shall pay to Lessor upon <br /> demand as additional rental for the cost of the repairs plus interest at the maximum <br /> legal rate in effect in the State of Texas from the date of payment by Lessor until <br /> repaid by Lessee. At the expiration of this Lease, Lessee shall surrender the <br /> Leased Premises in good condition, reasonable wear and tear, loss by fire, or other <br /> unavoidable casualty, alone excepted. <br /> 4.2 Maintenance of the runways, taxiways, entrance roads, driveways, existing parking <br /> lots, leading to and/or contiguous to the demised property, and unoccupied property <br /> of the Airport, except for the premises demised and leased by Lessee, shall remain <br /> the obligation of Lessor. Lessor shall be obligated to use airport revenue funds for <br /> maintenance. Lessor shall never have th€? obligation to use general, operating or <br /> bond funds for maintenance. <br /> ARTICLE V <br /> Alterations and Fixtures <br /> 5.1 Lessee shall not make any alterations, additions, or improvements to the Leased <br /> Premises without the prior written consent of Lessor, except for the installation of <br /> unattached movable trade fixtures. All alterations, additions, improvements and <br /> fixtures (other than unattached, movable trade fixtures) which may be made or <br /> installed by either party hereto upon the Leased Premises shall become the <br /> property of the Lessor at the termination of this Lease for any reason whatsoever, <br /> and at the termination of this Lease shall remain upon and be surrendered with the <br /> Leased Premises, unless Lessor requests their removal, in which event Lessee <br /> shall remove the same and restore the Leased Premises to their original condition <br /> at Lessee's expense. Any linoleum, carpeting, or other floor covering of similar <br /> character which may be cemented or otherwise affixed to the floor of the demised <br /> premises, and any pane!:ng or other wall covering shall e!se become tho property <br /> of the Lessor, all without credit or compensation to Lessee. <br /> 5.2 Lessee shall prevent any lien or obligation from being credited against or imposed <br /> upon the Leased Premises by reason of any alterations, repairs, labor performed <br /> ---- or materials furnished to the Leased Premises for or on behalf of Lessee and <br /> Lessee will discharge any lien or charge immediately after lien occur or charges <br /> become due and payable. <br />
