<br /> ! 7S'b <br /> -3- <br /> ARTICLE II. ABANDONED PROPERTY. <br />Division 1. Abandoned Property Other Than Motor Vehicles <br />Sec. 16-20. Definitions. <br />In this division: <br />(1) Abandoned personal property means any personal property other <br /> than a motor vehicle, left unattended on any public street, alley, <br /> sidewalk, park or any other property owned or controlled by the city, <br />(2) Impounded property means any abandoned personal property <br /> impounded by a police officer. <br />(3) Motor vehicle includes any motor vehicle subject to registration under <br /> the State Certificate of Title Act, and any motorboat or outboard motor. <br />Sec. 16-21. Authority to impound abandoned personal property. <br /> . <br />Abandoned personal property can create hazards to persons and property, <br />promote criminal activity, and' contribute to litter and blight, and is a public <br />nuisance, A police officer may remove or cause to be removed, to a place of <br />impoundment designated by the city manager, any abandoned personal <br />property, <br />Sec. 16-22. Report of abandonment. <br />A police officer who impounds abandoned personal property will complete an <br />incident report concerning the property, and a tag or other form of identification <br />will be securely fastened to the property, The incident report is prima facie <br />evidence in any court that the property is abandoned and a public nuisance. <br />Sec. 16-23. Seizure; in:1poundment. <br />(a) A police officer may cause any abandoned personal property to be <br />seized if the property appears to be connected to criminal activity or may <br />otherwise be useful as evidence in a criminal matter. <br />(b) The chief of police may provide for the impoundment and storage of <br />impounded property in any manner consistent with this division by the city or by <br />contract with an impoundment agency, <br />Sec. 16-24. Impoundment fees; lien on impounded property. <br /> . . <br />(a) Fees for all costs for the impoundment, storage and sale of impounded <br />property shall be charged to the owner an9 shall be paid to the city or the <br />impoundment agency in an amount set by separate ordinance. Fees for <br />newspaper publication notices, will be assessed at actual cost. <br /> , . <br /> . . <br />(b) A lien for all costs for the impoundh1Émt, storage and sale of property <br />under this division exists against the property in favor of the city and, in the event <br />the property is impounded by an impoundment agency for the city, the agency. <br />
