Regular Meeting June 5, 2007 Page 10 <br />GLASGOW SURVEY NO. 14, ABSTRACT 188, AND THE JOHN WILLIAMS SURVEY, <br />ABSTRACT 471, IN HAYS COUNTY, TEXAS IN CONNECTION WITH THE WONDER <br />WORLD DRIVE EXTENSION PROJECT; RATIFYING PREVIOUS NEGOTIATIONS AND <br />ACTIONS; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Thomaides moved for adoption of Resolution, and Mr. Guerrero seconded <br />the motion. Mr. Avila stated he provided an up to date description and the <br />right -of -way plat to replace the ones in the agenda packet. Mr. Thomaides <br />moved to amend the Resolution, to replace the exhibits to include the right - <br />of -way plat and description, and Mr. Guerrero seconded the motion. On roll <br />call the following vote was recorded: <br />AYE: Thomaides, Bose, Narvaiz, Guerrero and Robertson. <br />NAY: None. <br />ABSTAIN: Jones. <br />Mr. Guerrero inquired to eminent domain process. Mr. O'Leary stated when a <br />project needs to purchase property and intent is made to negotiate at <br />appraisal value for the property and the property owner rejects the offer, <br />then a panel of three citizens is formed to come up with a price. He stated <br />if the City or the property owner disagrees with the panel, then this can b <br />appealed to the court system. He stated the City does not like to go this <br />route, but this time it was unavoidable. Mr. Thomaides stated often times <br />eminent domain has a negative connotation, but this project is vital to the <br />future of the community. He stated the panel system is set up by the state <br />and the panel must follow the state guidelines. He stated usually this <br />turns out well for the property owner. The Council then voted unanimously <br />for adoption of Resolution. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S 2006 -2007 BUDGET TO FUND THE SALES TAX REBATE FOR <br />PRIME OUTLETS AT SAN MARCOS; AND DECLARING AN EMERGENCY. <br />Mr. Guerrero moved for adoption of an Ordinance on emergency, and Mr. Bose <br />seconded the motion. Mr. O'Leary stated the City entered into a sales tax <br />rebate agreement with Prime Outlet. He stated this is the first year of <br />this rebate. The Council then voted unanimously for adoption of Ordinance <br />on emergency. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />
