<br /> 91F <br /> furnished to the CITY by the Contractor. The extent of the duties, responsibilities and <br /> limitations of authority of the ARCHITECT as the CITY's representative during construction <br /> will not be modified or extended after the construction contract documents have been <br /> authorized by the CITY to be competitively bid without written consent of the CITY and the <br /> ARCHITECT and with notice to the Contractor. <br /> 1.5 ADDITIONAL SERVICES <br /> 1.5.1 Since the ARCHITECT's compensation is a fixed fee for Basic Services, including <br /> minor deviations from those described in this Agreement, compensation to the <br /> ARCHITECT for additional services will only be for substantial deviations from the scope <br /> of services described in this Agreement. <br /> 1.5.2 Additional services will be provided by ARCHITECT if authorized or confirmed in <br /> writing by the CITY and compensation will be in addition to that specified for Basic <br /> Services, in accordance with Section 13.2 of this Agreement. The approval of the CITY's <br /> governing body is necessary for all additional services the compensation for which <br /> exceeds $15,000. Additional services will include resident project representation beyond <br /> that provided as a part of Basic Services. <br /> ARTICLE 2 <br /> THE CITY'S RESPONSIBILITIES ~ <br /> 2.1 The CITY will provide full information to the ARCHITECT regarding requirements <br /> for the Project. Such information will include the CITY's design objectives, constraints and <br /> criteria, including space requirements and relationships, flexibility and expandability and <br /> special equipment and systems. <br /> 2.2 The CITY will provide a legal description of the site including a graphic survey of the <br /> property with all existing easements, setbacks, and utilities and a topographic survey. The <br /> CITY will also provide the results of an environmental assessment of the site prepared <br /> under separate contract. <br /> 2.3 The CITY will provide a budget for the Project which will include contingencies for <br /> bidding, changes in the work during construction, and other costs which are the <br /> responsibility of the CITY, including those described in this Article 2 and in Subsection <br /> 3.1.2. The ARCHITECT will accept the CITY's authorization to bid the Project as evidence <br /> that arrangements exist for the fulfillment of the financial obligations assumed by the CITY <br /> hereunder. <br /> 2.4 The CITY will designate a representative to act in the CITY's behalf with respect to <br /> the Project. The CITY and/or such authorized representative will examine the documents <br /> submitted by the ARCHITECT and will render responses pertaining thereto promptly and <br /> provide the ARCHITECT with the requested data or information in CITY's possession <br /> relating to the Project. <br />
