Ms. Barrett <br />stated the sales receipt can be used to establish the value of the modular <br />home and land to compare with the median value of the houses within 500 <br />feet. She also stated in terms of restrictions, foundation requirements <br />would not prevent the modular homes from being built. She also stated the <br />foundation requirements would apply to all homes. Mr. Mihalkanin asked <br />for the City Attorney and the Planning Department to work together to <br />provide the Council with the most palatable resolution to this issue. Mr. <br />Thomaides stated he supports notifying the neighborhoods when inquiries <br />are made in regard to placing a modular home in a neighborhood. Ms. <br />Barrett stated sending out notices to all neighborhoods would be very <br />costly. Mr. Taylor inquired to how peer and beam foundations would be <br />restricted. Ms. Barrett stated the amount of concrete poured at the edge <br />of the home could be increased. She stated peer and beam would still be <br />allowed, but we could require additional concrete. She stated a draft <br />Ordinance could be provided at the next Regular Council Meeting scheduled <br />for August 25, 2003. Mr. Montoya stated he has some concerns about this <br />issue. He stated some of these modular homes are better than stick built <br />homes. He stated allowing modular homes brings affordable housing to the <br />community. He stated he supports regulating the foundation of homes. Mr. <br />Taylor stated these modular homes can only run up costs for all homes. He <br />supports regulating these modular homes. Ms. Barrett stated deed <br />restrictions would not be enforced by the City. Ms. Narvaiz stated she <br />agrees with affordable housing with a quality traditional home. She <br />stated she supports the City Attorney and Planning Department reviewing <br />the City options on restrictions. The Council agreed by consensus for a <br />recommendation to be provided to the Council with any remedies in a form <br />of an Ordinance to be considered on emergency. <br /> <br />Mayor Habingreither introduced the City Council's Report. Mayor <br />Habingreither recommended postponing the Hispanic Chamber Workshop <br />scheduled for August 18, 2003. The Council agreed to postpone this <br />meeting to a later time. <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss W.C. Carson vs. City of San <br />Marcos, economic development contracts with San Marcos Hispanic Chamber of <br />Commerce and San Marcos Area Chamber of Commerce; schedule for <br />disannexation-Southwest San Marcos; and Section 551.074 to discuss <br />evaluation of a public officer (City Attorney)and duties of a public <br />officer (City Manager). Ms. Narvaiz moved the Council adjourn into <br />Executive Session at 11:19 p.m. and Mr. Mihalkanin seconded the motion, <br />which passed unanimously. <br /> <br />Mr. Mihalkanin moved the Council reconvene at 1:35 a.m. and Ms. Narvaiz <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced a discussion regarding Economic Development <br />Contracts.
