<br /> ,~lr <br /> course of conduct which might jeopardize any of the CITY's rights thereunder. <br /> 1.5,3 Attend a pre-construction conference with the Contractor, CM and members of <br /> CITY's staff, to establish construction schedules and to identify key representatives of the <br /> parties and lines of communication and assist the CITY and CM during the conference. <br /> 1.5.4 Assist the CITY and CM in ensuring that all applicable permits and approvals have <br /> been obtained from appropriate agencies prior to construction. <br /> 1.5,5 Make periodic on-site observations of the Project to ensure familiarity with the <br /> progress and quality of the work, to determine if the work is proceeding in acceptable <br /> conformance with the construction contract documents, and to review the work with the <br /> CITY and CM, Assist the CM in keeping the CITY informed of the progress and quality of <br /> the work, A total of 13 site visits is anticipated, <br /> : ' <br /> 1.5.6 Not have control or charge of and will not be responsible for construction means, <br /> methods, techniques, sequences or procedures, or for safety precautions and programs <br /> in connection with the work, for the acts or om issions of the Contractor, subcontractors or <br /> any other persons performing any of the work, or for the failure of any of them to carry out <br /> the work in accordance with the construction contract documents unless such acts or <br /> omissions are due to the negligence of the ENGINEER or are acts or om issions under the <br /> ENGINEER's control. However, ENGINEER will exercise its professional judgment on <br /> behalf of CITY during the construction phase so that all work performed by the Contractor <br /> results in a Project completed in accordance with the construction contract documents, and <br /> during any phase should the ENGINEER become aware of the Contractor's utilization of <br /> means, methods, techniques, sequences and/or procedures of construction which, in <br /> ENGINEER's opinion, will not result in completion of the Project in accordance with the <br /> construction contract documents or which are unsafe, ENGINEER will immediately inform <br /> the CITY and the CM. In such situations, the ENGINEER may recommend to the CITY <br /> and the CM that work by Contractor on the Project be immediately ceased, <br /> 1.5.7 At all times have access to the work wherever it is in preparation or progress, <br /> 1.5.8 Assist the CM in determining the amounts owing to the Contractor, <br /> 1,5.9 Analyze data from performance testing of equipment by the Contractor or supplier <br /> when the construction contract documents require the equipment to be tE;}sted after <br /> installation and submit test conclusions to the CITY and CM for review. <br /> 1.5.10 Review and make all decisions regarding the approval or taking of other <br /> appropriate action upon the Contractor's submittals, including but not limited to, shop <br /> drawings, and product data and samples, <br /> 1,5.11 Prepare minor changes in the plans and specifications as directed by the CITY and <br /> CM; and assist the CM in providing documentation for change orders, ENGINEER will not <br />
