accessory structures may utilize different styles and materials than the primary <br />structure upon review and approval by the Director of Development Services and <br />the Permit Center Manager, appealable to the Planning and Zoning Commission. <br />i. No bright unfinished or mirrored surfaces will be allowed. <br />4.04. Environmental. The Property Owner shall comply with all federal, state and <br />local storm water discharge registration, notification, monitoring and construction runoff <br />protection requirements and required erosion /sedimentation controls. With regard to <br />storm water drainage, the project shall not cause the run off of storm water drainage in <br />flows that are in excess of the existing flows off the Property in its present condition. <br />4.05. Lighting. The Project Site shall provide lighting levels that are compatible with <br />safety and industry standards for the uses permitted herein and shall meet the minimum <br />requirements of the City of San Marcos and are subject to review at the Site Plan <br />phase. All lighting shall be of a warm color light which is the color spectrum of <br />incandescent light and shall be shielded so as to provide no glare to adjacent properties <br />or street rights -of -way. <br />4.06. Maximum Height of Structures. The maximum height of structures constructed <br />on this site shall not exceed two and one -half (2.5) stories or 35 feet in height, <br />whichever is less. <br />4.07. Building Setbacks. The minimum building setbacks applicable to the Project <br />Site shall be as follows: <br />a. Minimum Front Yard Setback. The minimum required front yard shall be 20 <br />feet. Encroachments in the form of above grade awnings, bay windows, signage, <br />eaves, balconies and window sills shall be permitted in accordance with the <br />requirements of the LDC. <br />b. Minimum Side Yard Setback. The minimum side yards shall be five feet (5). <br />Encroachments in the form of above grade awnings, bay windows, signage, <br />eaves, balconies and window sills shall be permitted in accordance with the <br />requirements of the LDC. <br />c. Minimum Rear Yard Setback. The minimum rear yard setback shall be a <br />minimum of twenty feet (20') for all lots with the exception of those adjoining the <br />South and West property lines. Encroachments in the form of above grade <br />awnings, bay windows, signage, eaves, balconies and window sills shall be <br />permitted in accordance with the requirements of the LDC. <br />d. South and West Property Line Setback. The South and West boundary of the <br />property will include a 25 foot greenbelt area (the "Greenbelt Area ") and a 25 foot <br />building setback from the Greenbelt boundary resulting in an overall building <br />setback of 50 feet from the South and West boundary of the property. The <br />Greenbelt Area may include preserved trees, mitigated trees, and storm water <br />management features to be determined during the site preparation plan process <br />Restated Planned Development District 2012 <br />
