(h) Fraud and false statements. The reports and other documents required to be submitted or <br />maintained under this division shall be subject to: <br /> <br />(1) The provisions of 18 USC section 1001 relating to fraud and false statements: <br /> <br /> (2) The provisions of sections 309(c)(4) of the Act, as an~ended, governing false statements, <br />representation or certification; and <br /> <br />(3) The provisions of section 309(c)(6) of the Act regarding responsible corporate officers. <br /> <br />Sec. 86.124. Access to industrial user records. <br /> <br />(a) The control anthority shall have access to all industrial user records that pertain to that user's <br />discbarge to the POTW. The city reserves the right to inspect and copy information from the <br />industrial user. The industrial user is required to retain records of all information resulting from <br />any monitoring or reporting activity required by this division. The records shall be kept in <br />accordance with 40 CFR 403.12(0). <br /> <br />(b) Any person subject to terms of this division not otherwise exempted shall file with the <br />director a listing of all chemicals and compounds included uuder section 86.126 that are stored, <br />used, processed or transported. Lists shall include the chemical name, chemical composition and <br />common name, if any, mxd name of the manufacturer, including those chemicals not subject to <br />discharge or pretreatment as described in any other section of this division. Notification of <br />changes in this listing shall be reported to the director in wa'iting within seven days of the date <br />they occm'. Lists and/or MSDS for these chemicals and compormds should be submitted to the <br />city as soon as possible, thereafter. <br /> <br />(c) A person may not be required to disclose any classified data of the federal government or any <br />confidential information relating to secret processes or economics or operation. If the <br />information constitutes a trade secret or is commercial or financial information privileged or <br />made col~fidential by statute or judicial decision or if it is information which, if released, would <br />give advantage to competitors, the information is not open to public inspection and shall be kept <br />in confidence by the city. A person submitting data or information may request that it be <br />classified as confidential. The user must demonstrate the necessity to keep the material <br />confidential. Any documents determined to be confidential, must have the words "confidential <br />business informatioff' stamped on the document. However, the composition of any waste subject <br />to tbe jurisdiction of this division may not be regarded as confidential information. <br /> <br />(d) Chemical disclosure lists for exisfiug pelxnitted industrial users shall be filed with the director <br />within 30 days of the effective date of the ordinance from which this division derives. <br /> <br />Sec. 86.125. General discharge restrictions. <br /> <br />(a) No person shall discharge or cause to be discharged any drainage water into sanitary sewers <br />if a storm sewer is available.
