9¡;ß
-3-
All non-residential users not excluded from required
sampling will have an initial sampling of their waste
discharges performed, and sampling of these users will
be conducted thereafter at intervals of between one and
two years.
(d) Sampling Procedure.
(1) All sampling will be conducted by the city at
unannounced times. A sample shall consist of a
composite ofa minimum of four samples collected
at approximately equal intervals during the
operating period (the posted opening time until
one-hour after the posted closing time). A
duplicate sample will be provided to the user, if
requested, for delivery to a laboratory of the
user's choice for analysis. The result from the
laboratory selected by the user, including a copy
of the chain-of-custody form, must be sent by the
laboratory directly to the Director of Public
Works within 10 days of date of sampling. The
submittal from the user's laboratory must
include a copy of the laboratory Quality
Assurance Plan and a copy of the most recent
Quality Assurance Inspection Report of the Texas
Natural Resource Conservation Commission for the
laboratory.
(2) Provided that the user's laboratory result for
COD is within ten percent of . the City's
laboratory result, the lower reading of the two
sample results will be used for surcharge
determination. If the difference in results
between the two samples exceeds ten percent, a
portion of the original sample will be submitted
by the city to a third laboratory and the result
obtained will be used for surcharge calculation.
(3) A request for re-sampling must be submitted by a
user in writing to the Director of Public Works.
Only one re-sampling will be performed during the
one year period following the City's sampling.
The user will be charged a $200.00 fee for re-
sampling. Re-sampling will only be performed if
the user has modified or installed new, permanent
pretreatment facilities, or if the user has made
a significant change in process operations as
described in the request for resampling.
(4) The test parameter for all sampling will be
Chemical Oxygen Demand (COD).
(e) Sampling Results; Surcharge Participant List; Testing
Fee.
(1) Users whose sample result under subsection (d)
above exceeds 300 mg/l will be placed on the
surcharge participant list.
(2) Users whose sample result under subsection (d)
above is 300 mg/l of COD or less will not be
included on the surcharge participant list.
These users will be monitored annually thereafter
using grab samples. A duplicate of a grab sample
will be furnished to a user if requested.
(3) If a monitoring grab sample result under
subsection (e) (2) above, or a random grab sample
result under subsection (b) (2) above exceeds 400
mg/l of COD, then the sampling procedure in
