<br /> 9¡;ß <br /> -3- <br /> All non-residential users not excluded from required <br /> sampling will have an initial sampling of their waste <br /> discharges performed, and sampling of these users will <br /> be conducted thereafter at intervals of between one and <br /> two years. <br /> (d) Sampling Procedure. <br /> (1) All sampling will be conducted by the city at <br /> unannounced times. A sample shall consist of a <br /> composite ofa minimum of four samples collected <br /> at approximately equal intervals during the <br /> operating period (the posted opening time until <br /> one-hour after the posted closing time). A <br /> duplicate sample will be provided to the user, if <br /> requested, for delivery to a laboratory of the <br /> user's choice for analysis. The result from the <br /> laboratory selected by the user, including a copy <br /> of the chain-of-custody form, must be sent by the <br /> laboratory directly to the Director of Public <br /> Works within 10 days of date of sampling. The <br /> submittal from the user's laboratory must <br /> include a copy of the laboratory Quality <br /> Assurance Plan and a copy of the most recent <br /> Quality Assurance Inspection Report of the Texas <br /> Natural Resource Conservation Commission for the <br /> laboratory. <br /> (2) Provided that the user's laboratory result for <br /> COD is within ten percent of . the City's <br /> laboratory result, the lower reading of the two <br /> sample results will be used for surcharge <br /> determination. If the difference in results <br /> between the two samples exceeds ten percent, a <br /> portion of the original sample will be submitted <br /> by the city to a third laboratory and the result <br /> obtained will be used for surcharge calculation. <br /> (3) A request for re-sampling must be submitted by a <br /> user in writing to the Director of Public Works. <br /> Only one re-sampling will be performed during the <br /> one year period following the City's sampling. <br /> The user will be charged a $200.00 fee for re- <br /> sampling. Re-sampling will only be performed if <br /> the user has modified or installed new, permanent <br /> pretreatment facilities, or if the user has made <br /> a significant change in process operations as <br /> described in the request for resampling. <br /> (4) The test parameter for all sampling will be <br /> Chemical Oxygen Demand (COD). <br /> (e) Sampling Results; Surcharge Participant List; Testing <br /> Fee. <br /> (1) Users whose sample result under subsection (d) <br /> above exceeds 300 mg/l will be placed on the <br /> surcharge participant list. <br /> (2) Users whose sample result under subsection (d) <br /> above is 300 mg/l of COD or less will not be <br /> included on the surcharge participant list. <br /> These users will be monitored annually thereafter <br /> using grab samples. A duplicate of a grab sample <br /> will be furnished to a user if requested. <br /> (3) If a monitoring grab sample result under <br /> subsection (e) (2) above, or a random grab sample <br /> result under subsection (b) (2) above exceeds 400 <br /> mg/l of COD, then the sampling procedure in <br />
