<br /> 33 <br /> LEASE AGREEMENT <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> This Lease Agreement ("Lease") is made this 26th day of Jul y , <br /> 1994, between the City of San Marcos, Texas, a Texas municipal corporation ("Lessor") <br /> and the Texas Hill Country Chapter of the National Association for the Advancement of <br /> Colored People, a Texas nonprofit corporation ("Lessee"). <br /> RECITALS: <br /> 1. The Lessor is the owner of a wood frame building that was previously a part <br /> of the Dunbar School. <br /> 2. The Lessor's governing body declared this building to be surplus to the <br /> Lessor's needs and agreed to donate it to the Lessee in its Resolution 1994-18R on <br /> January 24, 1994. <br /> 3. The Lessor and the Lessee have as common goals the fostering of self- <br /> reliance, literacy, and education for the realization of the full potential of all members of <br /> the San Marcos community. <br /> 4. The Lessor, in partnership with the Lessee, is willing to lease an area of <br /> Lessor's property in the Dunbar Neighborhood to the Lessee so that the building can be <br /> relocated to that property, renovated by the Lessee, and operated as an "Empowerment <br /> Center" for these common goals and for the purposes described in this agreement. <br /> WITNESSETH: <br /> ; Lessor, for and in consideration of the Lessee's payment of rentals and <br /> performance of the covenants and agreements contained in this Lease, and for the further <br /> consideration of the renovation by Lessee of certain improvements to the premises, and <br /> Lessee's fulfillment of the goals and purposes described in this lease, has demised, <br /> leased, and let unto Lessee the 1.166 acre, more or less, tract of property in the City of <br /> San Marcos, Hays County described by metes and bounds in Exhibit A attached hereto <br /> and incorporated herein for all purposes (the "Premises"). <br /> To have and to hold unto the Lessee on the following terms and conditions: <br /> 1. Term. The term of this Lease is thirty (30) years commencing on the 1 st <br /> day of August, 1994, with the right to renew this Lease for a further term of thirty (30) <br /> years at the end of such term, with the written mutual consent of the Lessee and the Lessor. <br />
