Notice by mail shall be deemed to <br /> be received three days after posting. <br /> (b) In determining whether an electrician's license <br /> should be suspended, the electrical board shall proceed upon <br /> sworn written information furnished by an official of the <br /> city, or by any person aggrieved by the action of the <br /> electrician and filed with the building official. If the ¡ <br /> board deems the information sufficient to support further <br /> action, the board shall set a hearing on the matter within <br /> 30 days, and shall send a copy of the information to the <br /> licensee by certified mail not less than ten days before the <br /> date of the hearing. The licensee may appear in person, and <br /> may be represented by an attorney or any other person. All <br /> hearings shall be open to the public. The city and the <br /> licensee shall be entitled to present evidence and arguments <br /> at the hearing. If the licensee does not appear, the board <br /> may proceed to hear and determine the charges. If the <br /> licensee admits the truth of the charges, or if the board by <br /> vote of three or more members finds them to be true, it may <br /> suspend the license of the licensee. The board shall have <br /> the power, through its Chair or secretary, to administer <br /> oaths and to compel the attendance of witnes§es before it by <br /> subpoena by the Chair. The decision of the board in each <br /> suspension hearing shall be entered into the minutes of the <br /> board. <br /> Sec. 5-159. Automatic Suspension of license. <br /> (a) A license shall be automatically suspended upon final <br /> conviction of the licensee for taking out a permit and then <br /> permitting a person not authorized by this Article to do any <br /> electrical work under the permit. <br /> , <br /> (b) The suspension provided for in this section shall in <br /> the first instance be for a period of three months. In the <br /> event a license is suspended under this section a second or <br /> subsequent time, it shall be for a period of one year. <br /> (c) The suspension of any license shall be automatically <br /> extended upon the licensee being finally convicted of <br /> performing electrical work while his or her license is <br /> suspended with the extended period of suspension being for <br /> the same period as the original suspension, in addition to <br /> any other penalty assessed. <br /> Sec. 5-160. Surrender and return of license. <br /> Any license suspended under this Article shall be <br /> surrendered to the building official. At the end of the <br /> period of suspension, in the absence of further violations, <br /> the surrendered license shall be returned to the licensee <br /> and shall again be valid. If the period of suspension <br /> extends beyond the normal expiration date, the licensee must <br /> pay all license renewal fees in order to receive the license <br /> after completion of the suspension period. <br /> Sec. 5-161. Appeals. <br /> Any person denied a license or whose license has been <br /> suspended by the electrical board, except where such <br /> suspens1.on is automatic under this Article, may file a <br /> peti tion within ten days of the date of the denial or <br /> suspension for a hearing before the municipal court judge. <br /> At least ten (10) days written notice shall be given to the <br /> aggrieved person of the date of the hearing. The judge may <br /> take testimony, and shall determine whether there is <br /> substantial evidence to support the denial or suspension of <br /> the license. <br />
