These records shall be <br />maintained in accordance with city record retention <br />requirements, and shall be subject to public inspection <br />under the city's Open Records Act policy. <br />:10:1.4.7 is amended by deletion of the last sentence. <br /> <br />10:1.4.8 is amended to read as follows: <br />:10:1.4.8 Reports <br />The building official shall prepare and submit an annual <br />report of the activities of the division to the Director <br />of Planning and Development Services. The report shall <br />include a summary of decisions of the Construction Board <br />of Adjustments and Appeals. <br />102.3 is amended to read as follows: <br />102.3 stop Work Orders. <br />102.3.1 The building official, upon determining that work <br />on any building, structure, or swimming pool, or on any <br />electrical, gas, mechanical or plumbing ~ystem is being <br />done contrary to the provisions of Chapter 5 of the San <br />Marcos Code of Ordinances, or in a dangerous or unsafe <br />manner, may order that the work immediately cease. Such <br />order shall be in writing and shall be given to the owner <br />of the property, or to the owner's agent, or to the <br />person do ing the work, or if such persons cannot be <br />located, it may be posted in a conspicuous manner on the <br />premlses. The order shall state the conditions under <br />which work may be resumed. Where an imminent threat to <br />the safety of any person exists, the building official <br />may verbally order the work to be stopped. <br />102.3.2 It shall be unlawful for any person to perform, <br />or cause or permit the performance of, any work upon a <br />structure or system after a stop work order is issued <br />regarding such structure or system. Work on such <br />structure or system may be resumed only after the <br />def iciency has been corrected and approved on inspection. <br />A fee set by separate ordinance shall be charged for such <br />inspection. <br />:102.5 is amended to read as follows: <br />:102.5 Unsafe buildings or systems. <br />All unsafe buildings, structures and mechanical, <br />plumbing, natural gas and electrical systems are hereby <br />declared to be public nuisances and shall be abated by <br />vacating, securing, repair or demolition in accordance <br />with the provisions of Article VII of Chapter 5 of the <br />San Marcos Code of Ordinances. <br />103.1 is amended by addinq 103.1.6 and 103.1.7 to read as <br />follows: <br />:103.:1.6 Permit Cancellation <br />If the holder of a permit fails or refuses to complete <br />the work that had been permitted, the owner or person in <br />charge of construction on behalf of the owner, may, upon <br />written request to the building official, request that <br />the original permit be canceled. Forty eight (48) hours <br />after this request is received a subsequent permit may <br />then be issued to complete the work involved. <br />103.1.7 Permits without Approved Plats <br />
