These records shall be maintained in accordance with city record retention requirements, and shall be subject to public inspection under the city's Open Records Act policy. :10:1.4.7 is amended by deletion of the last sentence. 10:1.4.8 is amended to read as follows: :10:1.4.8 Reports The building official shall prepare and submit an annual report of the activities of the division to the Director of Planning and Development Services. The report shall include a summary of decisions of the Construction Board of Adjustments and Appeals. 102.3 is amended to read as follows: 102.3 stop Work Orders. 102.3.1 The building official, upon determining that work on any building, structure, or swimming pool, or on any electrical, gas, mechanical or plumbing ~ystem is being done contrary to the provisions of Chapter 5 of the San Marcos Code of Ordinances, or in a dangerous or unsafe manner, may order that the work immediately cease. Such order shall be in writing and shall be given to the owner of the property, or to the owner's agent, or to the person do ing the work, or if such persons cannot be located, it may be posted in a conspicuous manner on the premlses. The order shall state the conditions under which work may be resumed. Where an imminent threat to the safety of any person exists, the building official may verbally order the work to be stopped. 102.3.2 It shall be unlawful for any person to perform, or cause or permit the performance of, any work upon a structure or system after a stop work order is issued regarding such structure or system. Work on such structure or system may be resumed only after the def iciency has been corrected and approved on inspection. A fee set by separate ordinance shall be charged for such inspection. :102.5 is amended to read as follows: :102.5 Unsafe buildings or systems. All unsafe buildings, structures and mechanical, plumbing, natural gas and electrical systems are hereby declared to be public nuisances and shall be abated by vacating, securing, repair or demolition in accordance with the provisions of Article VII of Chapter 5 of the San Marcos Code of Ordinances. 103.1 is amended by addinq 103.1.6 and 103.1.7 to read as follows: :103.:1.6 Permit Cancellation If the holder of a permit fails or refuses to complete the work that had been permitted, the owner or person in charge of construction on behalf of the owner, may, upon written request to the building official, request that the original permit be canceled.
