<br /> ,;~j) <br /> -5- <br />each floor when limited by law. <br />103.9.1.3 A certificate of occupancy for any existing <br />building may be obtained by applying to the building <br />official and supplying the information and data necessary <br />to determine compliance with this Chapter and other <br />applicable laws for the occupancy intended. Where <br />necessary, in the opinion of the building official, two <br />sets of detailed drawings or a general inspection, or <br />both, may be required. <br />103.9.1.4 utility service to any non-residential <br />structure, occupancy or use shall not be instituted or <br />transferred from one account holder to another until the <br />utility service provider has received a utility release <br />from the building official based upon the official's <br />issuance of a certificate of occupancy for the structure, <br />occupancy or use. <br />103.9.1.5 A certificate of occupancy shall be required <br />for occupancy of non-residential structures that have <br />been vacant for more than six months, regardless of <br />change of use or occupancy classification. <br /> ~ <br />103.9.1.6 A fee as established by separate ordinance <br />will be charged for issuance of certificates of occupancy <br />not involving a building permit. <br />103.9.1.7 A certificate of occupancy is proof that a <br />structure or system is complete and for certain types of <br />permits is released for use and may be connected to a <br />utility system. This certificate does not grant <br />authority to occupy a building, such as a shell building, <br />prior to the issuance of a certificate of occupancy. <br /> , <br />105.3 is amended to read as follows: <br />105.3 Powers. <br />The Construction Board of Adjustments and Appeals shall <br />have the authority to hear appeals of decisions and <br />interpretations of the building official, and to consider <br />and grant variances of Chapter 5 of the San Marcos Code <br />of Ordinances, except in matters arising under the <br />National Electrical Code, which shall be determined by <br />the electrical board. <br />106 and 107 are deleted. <br />508 is deleted. <br />1114.3 is deleted. <br />Chapter 30 is deleted. <br />3208 is hereby amended to read as follows: <br />3208 Wood shingles and Shakes. <br />Wood shingles and shakes are prohibited as new or <br />replacement roofing material. <br />APpendix C is amended to read as follows: <br />C101 CABO One and Two Fami1y Dwe11ing Code <br />All detached one or two-family dwellings not more than <br />three (3) stories in height and their accessory <br />structures may be designed and constructed in accordance <br />with the 1992 edition of the CABO One and Two Family <br />
