SERVICE PLAN <br />FOR THE ANNEXATION OF THE 23.41 ACRE <br />LOWMAN TRACT <br />March 24, 1993 <br />Pursuant to the provisions of Texas Local Government Code Chapter 43, Subchapter C, Section 43.056, <br />the following service plan is hereby adopted for the annexation of a 23.41 acre tract adjoining the existing <br />City limits on the west side of IH -35, south of Centerpoint Road: <br />1. Police Protection - <br />Police services, including patrolling, response to calls and other routine services, will be <br />provided immediately upon annexation using existing personnel and equipment; <br />2. Fire Protection - <br />Fire protection services, including emergency response calls, will be provided immediately <br />upon annexation using existing personnel and equipment and within the limitations of the <br />available water supply to be provided by others. The first responding station is located at the <br />corner of Broadway and Parker Streets; <br />3. Solid Waste Collection - <br />Solid waste collection services will be made available to all residential areas immediately <br />upon annexation. Businesses and institutions must make arrangements with private haulers <br />for solid waste disposal; <br />4. Provision of Water and Wastewater Services in the Annexed Area - <br />Water service is to be provided by the property owner's extension of and connection to the <br />facilities of the Elim Water Company which holds a Certificate of Convenience and <br />Necessity (CCN) for the area. <br />The property owner will be required to extend and connect to the existing City wastewater <br />facilities in accordance with the City's development ordinances. Upon completion and <br />dedication of the new facilities to the City, the City shall provide maintenance of the <br />facilities. The City's utility policy may be summarized as follows: <br />"Extension of City Facilities: Where it is necessary, in the order to properly <br />serve the subdivision, that extension of existing City utilities be made to that <br />drainage facilities be constructed outside the subdivision, which extensions <br />of such facilities are here referred to as "off-site improvements," the <br />subdivider shall install such off-site improvements of such a size as to <br />adequately serve the area being subdivided at his own expense; however, if <br />the City should require the construction of off-site improvements of a size <br />greater than set out above, then the City shall within one year after date of <br />approval of the final construction plans, reimburse the subdivider for any <br />increased cost of such facilities." <br />
