<br />100 <br /> <br />regular meeting <br /> <br />february 23, 1981 <br /> <br />page four <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />~MENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 45.70 ACRES OUT OF THE <br />J . M. VERAMEND I LEAGUE NO. Tí-vO, LOCATED ON 1. H. 35 NORTH, FROM" D" <br />(MULTI-FAMILY DI'V'ELLING DISTRICT), "M" (MIXED) AND "c" (COMMERCIAL) TO <br />"c" (COMMERCIAL) AND "I" (INDUS'I'RIAL). <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading. Mr. Cavazos <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Cavazos, James, Kraus, Tarbutton <br /> <br />NAY: <br /> <br />Norris <br /> <br />ABSTAIN: <br /> <br />Stokes <br /> <br />The Mayor introduced for consideration a public hearing and first reading <br />on zoning of 0.38 acres out of the J.M. Veramendi League No. One, located <br />on Hunter Road, from "AO" (Agricultural-Open Space District) to "c" <br />(Commercial). The Mayor then opened the public hearing. No one wished to <br />speak either for or against the zoning request. The Mayor then closed the <br />public hearing. The City Secretary then read the Ordinance in its entirety, <br />the caption of which follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, 'I'EXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY ZONING 0.38 ACRES OUT OF THE J.M. VERAJ1ENDI <br />LEAGUE NO. ONE, LOCATED ON HUNTER ROAD, FROM "AO" (AGRICUL'I'URAL-OPEN <br />SPACE DISTRICT) TO "c" (COMHERCIAL). <br /> <br />Mr. Stokes moved to approve the Ordinance on first reading. <br />seconded the motion, which passed unanimously. <br /> <br />Mr. James <br /> <br />The Mayor introduced for consideration a public hearing and first <br />reading on changing the zoning of Lots 7, Band 9 of Block 4 of the <br />H.E. Barber Addition, from lip" (Public Use) to "R-l" (Single Family <br />Residential). The Mayor then opened the public hearing. Charles Evans, <br />Mrs. Ball, Mrs. Thomas, Mr. & Mrs. Hoffman and Mr. Cates spoke against <br />the zoning change. Jake Krauskopf, agent for the applicant, spoke in favor <br />of the zoning change. The Mayor then closed the public hearing. The City <br />Secretary then read the Ordinance in its entirety, the caption of which <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SEC'l'ION 3 OF THAT ORDINANCE NHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF LOTS 7,8 AND 9 OF BLOCK <br />4 OF THE H.E. BARBER ADDITION, FROM "P" (PUBLIC USE) TO "R-l" (SINGLE <br />FAMILY RESIDENTIAL). <br /> <br />Mr. Stokes stated that he felt there was a legal limit to restricting the <br />use of property by owners. He felt this should be tabled until the applican <br />and the neighbors could get together and discuss the zoning change. Mr. <br />Stokes moved to table this item until the March 23rd council meeting. Mr. <br />Tarbutton seconded the motion, which passed unanimously. The City Manager <br />noted that when a zoning change is tabled until a specific date, no <br />further notice is given to surrounding property owners. If the item <br />is tabled indefinitely, notice is given again. <br /> <br />The Mayor introduced for consideration a public hearing and first reading <br />on changing the zoning of Lot No.1 and part of Lot No.2 in Block 15 of <br />the Lindsey Harvey Addition from "P" (Public Use) to liD" (Multi-Family <br />Dwelling District). The Mayor then opened the public hearing. No one wishe <br />to speak against the zoning change. Kenneth Sutton, agent for the applicant <br />spoke in favor of the change request. The Mayor then closed the public <br />hearing. The City Secretary read the Ordinance in its entirety, the caption <br />of which follows: <br />
