<br />101 <br /> <br />regular meeting <br /> <br />february 23, 1981 <br /> <br />page five <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF LOT NO.1 AND PART OF <br />LOT NO.2 IN BLOCK 15 OF THE LINDSEY HARVEY ADDITION FROM "P" (PUBLIC <br />USE) TO "D" (MULTI-FAMILY DWELLING DISTRICT). <br /> <br />The Mayor brought up the question of requesting right-of-way. The City <br />Attorney felt that there may be legal difficulties with this. The City <br />Manager stated that right-of-way could be of some concern in the future. <br />He further stated that the zoning process was to address planning concerns <br />such as traffic and the like. It is the City's obligation to point out <br />the future problems that may arise. Mrs. Norris moved to approve the <br />Ordinance on first reading. Mr. Tarbutton seconded the motion, which passed <br />unanimously. <br /> <br />The Mayor introduced for consideration a public hearing and first reading <br />on changing the zoning of 2.06 acres out of the Elijah Clark Survey No. 11, <br />located at 1519 Ranch Road 12, from "P-2" (Public or Private Educational <br />Institutions) to "R-l" (Single Family Residential) and "OP" (Office/ <br />Professional). The Mayor then opened the public hearing. No one wished to <br />speak in opposition to the zoning change. Charles Swart, applicant, spoke <br />in favor of his request. The Mayor then closed the public hearing. The <br />City Secretary then read the Ordinance in its entirety, the caption of which <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN M~RCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 2.06 ACRES OUT OF THE <br />ELIJAH CLARK SURVEY NO. 11, LOCATED AT 1519 RANCH ROAD 12, FROM "P-2" <br />(PUBLIC OR PRIVATE EDUCATIONAL INSTITUTIONS) TO "R-l" (SINGLE FAMILY <br />RESIDENTIAL) AND "OP" (OFFICE/PROFESSIONAL). <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading. <br />seconded the motion, which passed unanimously. <br /> <br />Hr. Brown <br /> <br />The Mayor introduced for consideration a public hearing and first reading <br />on changing the zoning of 11.179 acres, located on Prospect and Columbia <br />Streets, from "R-l" (Single Family Residential) to "R-2" (Duplex Dwelling <br />District). Joe Garza stated that this zoning change had been withdrawn <br />at the applicant's request. The Mayor went ahead and opened the public <br />hearing. Lee Mitchell, Harvey Ginsburg and Billy Moore spoke against the <br />proposed zoning change. The Mayor then closed the public hearing. Mr. <br />Stokes moved to table this item indefinitely. Mrs. Norris seconded the <br />motion, which passed unanimously. Mr. Stokes stated that he felt that the <br />applicant should speak first in zoning requests. The Mayor stated that he <br />would then have the.applicant and those in favor of the change speak first, <br />those against next, with a rebuttal from the applicant at the discretion <br />of the Mayor. <br /> <br />The Mayor then introduced for consideration a public hearing to consider <br />annexing 57.67 acres, more or less, out of the J.M. Veramendi League No. <br />One, A-17 and the James Curtis Survey A-3, bounded by F.M. 621, State Fish <br />Hatchery, San Marcos River, the 24.96 acre tract owned by Rogers Wilson and <br />the 5 acre tract owned by Billy Tom Sanders. Mr. James moved to have first <br />reading on this item on March 9th. Mrs. Norris seconded the motion. On <br />roll call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Cavazos, James, Kraus, Norris <br /> <br />NAY: <br /> <br />Stokes <br /> <br />ABSTAIN: <br /> <br />Tarbutton <br /> <br />The Mayor introduced for consideration annexing 119.21 acres, more or less, <br />
