<br /> I /b cr <br /> City will not be responsible for any other explanation or interpretation of the <br /> proposed specifications made or given prior to the award of the contract. Any <br /> objections to the specifications and requirements as set forth in this proposal must be <br /> filed in writing with the Purchasing Manager no later than five (5) working days prior <br /> to the scheduled proposal opening. <br /> 3.03 Withdrawal of Proposal. <br /> A proposal may be withdrawn by a vendor only by a written request received by the <br /> City prior to the time set for proposal opening. Proposals may not be withdrawn <br /> after the time set for the proposal opening. <br /> 3.04 Opening of Proposals. <br /> Proposals will be opened so as to avoid disclosure of contents to competing vendors, <br /> and shall be kept secret during the process of negotiation. Only the total cost <br /> submitted by each vendor will be announced. However, all proposals shall be open <br /> for public inspection after contract award except for trade secrets and confidential <br /> information contained in the proposals and identified as such. <br /> 3.05 Late Proposals or Modifications. <br /> Proposals and modifications received after the deadline set for th~ proposal <br /> submission will not be considered. <br /> 3.06 Rejection of Proposals. <br /> The City may reject all proposals and readvertise if appropriate, whenever it is <br /> deemed in the best interest of the City to do so, and may reject any part of a <br /> proposal. Issuance of this Request for Proposals does not commit the City to pay any <br /> costs incurred in the preparation of a proposal or to procure or contract for its <br /> contents. The City may waive any minor informalities or irregularities in any <br /> proposal. <br /> 3.07 Technical Representatives. <br /> The issuance of advice, approvals, or instructions by the City's technical personnel or <br /> other representatives shall be deemed expressions of personal opinion only and shall <br /> not affect the City's or the vendor's rights and obligations hereunder unless same is in <br /> writing which is signed by an authorized representative of the City and expressly <br /> states that it constitutes an addendum to the proposal documents. The City's <br /> technical personnel may render assistance, or give technical advice to, or exchange <br /> infonnation with, the vendor's personnel in liaison effort concerning the goods and <br /> services to be furnished hereunder. Such exchange of infonnation or advice shall <br /> neither authorize the vendor to change the goods or services hereunder, or the <br /> provisions of the Request for Proposals, nor shall such change in the provisions of <br /> RFP 94-00 I <br /> Page 10 <br />
