<br />-13- <br /> <br />activities shall be 18 years of age or <br />younger, and have League approval. The <br />City shall repair any damage that occurs <br />to the Complex resulting from city- <br />sanctioned activities. Damages resulting <br />from League sanctioned activities will be <br />repaired at the League's expense. <br /> <br />(5) The League agrees to maintain the Complex <br />in a condition suitable for the playing <br />of baseball/softball games from January 1 <br />to August 15, and the remainder of the <br />year should a Fall program be conducted. <br />It shall be the responsibility of the <br />League to deposit all refuse from the <br />Complex area in garbage refuse containers <br />provided by the City and to keep the <br />Complex in a sani tary and sightly <br />condition at all times during the period <br />from January 1 to August 15 of each year <br />or year round if a Fall program is <br />conducted. The City shall provide water, <br />sewer and electricity services to the <br />Complex at the City's expense. The City <br />shall maintain all areas of Ramon Lucio <br />Park outside the Complex at all times <br />during the year and shall maintain the <br />Complex during the times when the League <br />is not exclusive user of the Complex. <br /> <br />(6) The League shall not discriminate on the <br />basis of religion, race, sex, physical <br />disability or national origin in the <br />conduct of its activities. <br /> <br />(7) The League shall procure insurance <br />against liability arising out of the <br />negligence or willful misconduct of the <br />League, the League's servants, agents or <br />employees in a minimum amount of $250,000 <br />for injuries to anyone person, and <br />$500,000 for all injuries to persons <br />arising from each occurrence; and <br />$100,000 for property damage. The City <br />shall be named an additional insured <br />under the policy. The policy shall <br />provide that it may not be canceled or <br />amended without ten (10) days written <br />notice by registered mail to the City. A <br />certificate of insurance shall be <br />delivered by the League to the City <br />within ten (10) days of the execution of <br />this lease and annually 'thereafter. The <br />minimum limits of any required insurance <br />shall not limit the league I s liability <br />under Part (8) of this lease. <br /> <br />(8) The League shall indemnify, defend, and <br />hold harmless the City and all officers, <br />agents and employees of the City from any <br />and all damages, claims, losses, demands, <br />suits, judgments, costs, and expenses <br />arising in connection with the <br />construction and operation by League of a <br />baseball/softball complex at Ramon Lucio <br />Park pursuant to the terms of this lease. <br /> <br />(9) (a) The League reserves the right to <br />terminate this lease at any time <br />upon six months advance written <br />
