<br />-14- <br /> <br />notice to the city. Upon <br />termination of this lease by the <br />League, the City agrees to permit <br />the League to remove any equipment <br />or structures from the property <br />which may be reused or relocated at <br />a different site and the City also <br />agrees to consider any request by <br />the League for a use agreement or <br />lease of alternate City property <br />under terms similar to those in this <br />lease. <br /> <br />(b) Should the League default in <br />performing any of its <br />responsibilities, the City shall <br />give the League notice in writing of <br />such default, and if League shall <br />fail or refuse to cure the default <br />within sixty (60) days after service <br />of the notice, the City may <br />terminate and cancel this lease. <br /> <br />(c) Upon any breach or termination of <br />this lease by the ci ty which <br />requires the League to relocate its <br />complex to a site other than Ramon <br />Lucio Park, the City agrees to <br />reimburse the League for any <br />structures and improvements <br />constructed by the League which <br />cannot reasonably be relocated to <br />the ,new site. The amount of <br />reimbursement shall be the appraised <br />value of the structures and <br />improvements at time of relocation. <br />Property will be appraised by three <br />(3) independent appraisers approved <br />by the City and League. The mid- <br />value appraisal estimate will be the <br />accepted reimbursement. The ci ty <br />will also reimburse the League for <br />any costs incurred dúe to <br />dismantling and moving those <br />structures and improvements <br />considered as being reasonably able <br />to be relocated. <br /> <br />(10) The League may operate a concession <br />service for the sale of food, drinks and <br />souvenirs in the Complex. Alcoholic <br />beverages shall not be sold at the <br />concession. All profits from the <br />concession shall be used for the <br />operation of the League's program and the <br />construction and maintenance of the <br />Complex, and for no other purpose. <br /> <br />(11) The League shall not assign any rights or <br />responsibilities under this Agreement <br />without first receiving written approval <br />of the city. <br /> <br /> <br />SECTION 4. That the election precincts for this election <br />shall be, in all respects, the same precincts as those Hays County <br />Election Precincts which are within the corporate limits of the <br />City of San Marcos and all those Hays, Caldwell, and Guadalupe <br />County Election Precincts which are within the boundaries of the <br />San Marcos Consolidated Independent School District. <br />
