<br />4. Specifications <br /> <br />Based on the Design and Construction Documents and any further <br />adjustments in the scope or quality of the Project or in the Project <br />budget authorized by the OWNER, the ARCHITECT shall prepare the plans <br />and technical specifications, subject to review and approval by the <br />OWNER. <br /> <br />ARCHITECT shall submit the approved plans and specifications to the <br />Texas Department of Licensing and Regulation (the "Department") for <br />review and approval of handicap accessibility features prior to the <br />time that construction begins. ARCHITECT shall be responsible for any <br />subsequent resubmittals of the plans and specifications as required by <br />the Department. <br /> <br />1.5 BIDDING PHASE ARCHITECT shall assume the responsibility for the <br />printing of drawings and specifications and the distribution of <br />construction contract documents to prospective bidders and to area plan <br />rooms. ARCHITECT shall answer all questions of prospective or <br />potential bidders and OWNER's staff, make all necessary clarifications <br />and interpretations of the construction contract documents, and be <br />responsible for the issuance of addenda (if any). ARCHITECT shall <br />conduct the bid opening and manage all project related paperwork <br />between the bid opening and the beginning of construction. The OWNER <br />reserves the right to issue a Notice to Proceed to the Contractor. <br /> <br />1.6 COlfSTRUC'l"IOlf PHASE--ADlIIlfISmA"rIOlf OF "rIlE COlfSTRUCTIOR COII"l"RAC'1' <br />The Construction Phase will commence with the award of the Contract for <br />Construction by the OWNER and will terminate when the Project has been <br />accepted by the OWNER. <br /> <br />1.7 The ARCHITECT shall be responsible for the observation of <br />construction at periodic intervals, with written reports to OWNER; <br />review and approval of shop drawings and submittals, review and <br />authorization of the Contractor's monthly applications for payment, <br />administration of any change orders required, final inspections <br />required, one year warranty inspection. <br /> <br />1.8 TIME The ARCHITECT shall submit to the OWNER within sixty (60) <br />days of the effective date of this contract, the final drawings and <br />specifications as reviewed and finally approved by the OWNER. <br /> <br />ARTICLE 2 <br />QWRER"S RESPORSIBILI"rIES <br /> <br />2.1 The OWNER shall provide access to and make all necessary <br />provisions for the ARCHITECT to enter upon public and private property <br />as required for the ARCHITECT to perform services under this Agreement. <br /> <br />2.2 The OWNER shall furnish required information and services and <br />shall render responses and conduct its review of written materials as <br />expeditiously as possible. <br /> <br />2.3 Unless otherwise notified by the OWNER, the OWNER's representative <br />regarding this contract shall be Mr. Robert Higgs, Director of OWNER's <br />Electric Utility Department. <br />
