4. Specifications Based on the Design and Construction Documents and any further adjustments in the scope or quality of the Project or in the Project budget authorized by the OWNER, the ARCHITECT shall prepare the plans and technical specifications, subject to review and approval by the OWNER. ARCHITECT shall submit the approved plans and specifications to the Texas Department of Licensing and Regulation (the "Department") for review and approval of handicap accessibility features prior to the time that construction begins. ARCHITECT shall be responsible for any subsequent resubmittals of the plans and specifications as required by the Department. 1.5 BIDDING PHASE ARCHITECT shall assume the responsibility for the printing of drawings and specifications and the distribution of construction contract documents to prospective bidders and to area plan rooms. ARCHITECT shall answer all questions of prospective or potential bidders and OWNER's staff, make all necessary clarifications and interpretations of the construction contract documents, and be responsible for the issuance of addenda (if any). ARCHITECT shall conduct the bid opening and manage all project related paperwork between the bid opening and the beginning of construction. The OWNER reserves the right to issue a Notice to Proceed to the Contractor. 1.6 COlfSTRUC'l"IOlf PHASE--ADlIIlfISmA"rIOlf OF "rIlE COlfSTRUCTIOR COII"l"RAC'1' The Construction Phase will commence with the award of the Contract for Construction by the OWNER and will terminate when the Project has been accepted by the OWNER. 1.7 The ARCHITECT shall be responsible for the observation of construction at periodic intervals, with written reports to OWNER; review and approval of shop drawings and submittals, review and authorization of the Contractor's monthly applications for payment, administration of any change orders required, final inspections required, one year warranty inspection. 1.8 TIME The ARCHITECT shall submit to the OWNER within sixty (60) days of the effective date of this contract, the final drawings and specifications as reviewed and finally approved by the OWNER. ARTICLE 2 QWRER"S RESPORSIBILI"rIES 2.1 The OWNER shall provide access to and make all necessary provisions for the ARCHITECT to enter upon public and private property as required for the ARCHITECT to perform services under this Agreement. 2.2 The OWNER shall furnish required information and services and shall render responses and conduct its review of written materials as expeditiously as possible. 2.3 Unless otherwise notified by the OWNER, the OWNER's representative regarding this contract shall be Mr. Robert Higgs, Director of OWNER's Electric Utility Department.
