<br />2.4 The OWNER shall provide the ARCHITECT with a survey of the Project <br />area, which will show boundaries, property lines, overhead and <br />underground utilities, existing buildings and topographical contours. <br /> <br />ARTICLE 3 <br />Olrf'-OF-POCKE'l" <br /> <br />3.1 Out-of-pocket expenses include actual expenditures made by the <br />ARCHITECT in the interest of the Project for blueprints, printing and <br />mailing costs, and shall be billed to the OWNER at cost. These <br />expenses shall be in addition to the ARCHITECT's compensation described <br />in Article 11 and shall not exceed $500.00 in total amount. <br /> <br />ARTICLE 4 <br />PAYIIEIr.rS TO "rBE ARCHIDC'l' <br /> <br />4.1 Payments for services shall be made to ARCHITECT on a bi-monthly <br />basis for the percentage completed in each phase of the Project, and <br />following receipt by OWNER of ARCHITECT's invoice therefor in the <br />amounts set forth in Paragraph 11.1 of this Agreement. <br /> <br />4.2 PROJECT SUSPENSION OR TERMINATION If the Project is suspended or <br />abandoned in whole or in part for more than six ( 6 ) months, the <br />ARCHITECT shall be compensated for all services performed prior to <br />receipt of written notice from the OWNER of such suspension or <br />abandonment. <br /> <br />ARTICLE 5 <br />ARCHITEC'l" S ACCOUlf'.flING RECORDS <br /> <br />5.1 All expense records of ARCHITECT shall be kept on a recognized <br />accounting basis acceptable to the OWNER and shall be available to the <br />OWNER or the OWNER's authorized representative at mutually convenient <br />times. <br /> <br />ARTICLE 6 <br />OWRERSHIP ARD USE OF IlOClJlIEftS <br /> <br />6.1 Plans, specifications, and other construction contract documents <br />as well as all tracings, survey notes and other original documents <br />shall become the property of the OWNER whether the Project for which <br />they are made is executed or not. However, ARCHITECT shall not be <br />responsible for any unintended or unlawful use of the plans, <br />specifications and construction contract documents by the OWNER or <br />others. <br /> <br />ARTICLE 7 <br />DIUlINATIOH OF AGREEIIER'r <br /> <br />7.1 This Agreement may be terminated at will by the OWNER upon at <br />least fifteen (15) days' prior written notice to the ARCHITECT. <br /> <br />7.2 In the event of termination as provided in this Article, the <br />ARCHITECT shall be compensated for all services performed to the <br />termination date which are deemed by OWNER to be in accordance with <br />this Agreement. Such amount shall be paid by the OWNER upon the <br />ARCHITECT'S delivering or otherwise making available to the OWNER, all <br />data, reports, estimates, summaries, and such other information and <br />materials as may have been accumulated by the ARCHITECT in performing <br />
