2.4 The OWNER shall provide the ARCHITECT with a survey of the Project area, which will show boundaries, property lines, overhead and underground utilities, existing buildings and topographical contours. ARTICLE 3 Olrf'-OF-POCKE'l" 3.1 Out-of-pocket expenses include actual expenditures made by the ARCHITECT in the interest of the Project for blueprints, printing and mailing costs, and shall be billed to the OWNER at cost. These expenses shall be in addition to the ARCHITECT's compensation described in Article 11 and shall not exceed $500.00 in total amount. ARTICLE 4 PAYIIEIr.rS TO "rBE ARCHIDC'l' 4.1 Payments for services shall be made to ARCHITECT on a bi-monthly basis for the percentage completed in each phase of the Project, and following receipt by OWNER of ARCHITECT's invoice therefor in the amounts set forth in Paragraph 11.1 of this Agreement. 4.2 PROJECT SUSPENSION OR TERMINATION If the Project is suspended or abandoned in whole or in part for more than six ( 6 ) months, the ARCHITECT shall be compensated for all services performed prior to receipt of written notice from the OWNER of such suspension or abandonment. ARTICLE 5 ARCHITEC'l" S ACCOUlf'.flING RECORDS 5.1 All expense records of ARCHITECT shall be kept on a recognized accounting basis acceptable to the OWNER and shall be available to the OWNER or the OWNER's authorized representative at mutually convenient times. ARTICLE 6 OWRERSHIP ARD USE OF IlOClJlIEftS 6.1 Plans, specifications, and other construction contract documents as well as all tracings, survey notes and other original documents shall become the property of the OWNER whether the Project for which they are made is executed or not. However, ARCHITECT shall not be responsible for any unintended or unlawful use of the plans, specifications and construction contract documents by the OWNER or others. ARTICLE 7 DIUlINATIOH OF AGREEIIER'r 7.1 This Agreement may be terminated at will by the OWNER upon at least fifteen (15) days' prior written notice to the ARCHITECT. 7.2 In the event of termination as provided in this Article, the ARCHITECT shall be compensated for all services performed to the termination date which are deemed by OWNER to be in accordance with this Agreement.
