<br /> ARTICLE 2 <br /> THE CITY'S RESPOHSIBILITIES <br /> The CITY shall render services as follows: <br /> 2.1 Provide a budget for the Project which shall include <br /> contingencies for bidding, changes in the work during construction, <br /> and other costs which are the CITY's responsibility, including those <br /> described in this Article 2 and in Subparagraph 3.1.2. The CONSULTANT <br /> shall accept the CITY's authorization to bid the Project as evidence <br /> that arrangements exist for fulfillment of the financial obligations <br /> assumed by the CITY hereunder. <br /> 2.2 Designate a representative authorized to act in the CITY's behalf <br /> with respect to the Project. The CITY and/or such authorized <br /> representative shall examine the documents submitted by the CONSULTANT <br /> and shall render responses pertaining thereto promptly and provide CITY <br /> with requested data or information in the CITY's possession relating <br /> to the Project. <br /> 2.3 Provide access to and make all necessary provisions for the <br /> CONSULTANT to enter upon public and private property as required for <br /> the CONSULTANT to perform its services under this Agreement. <br /> 2.4 Furnish necessary geotechnical, structural, mechanical, chemical, <br /> soils and other laboratory tests, inspections and reports as required <br /> by law or the construction contract documents or as reasonably needed <br /> by the CONSULTANT. The CONSULTANT shall not be held responsible for <br /> its reliance on any such information supplied by CITY provided that <br /> CONSULTANT does not know or reasonably cannot be expected to know of <br /> any deficiency or error in such information supplied by CITY. <br /> 2.5 Acquire all land and right-of-way required for completion of the <br /> Project. <br /> 2.6 Furnish all legal, accounting and insurance counseling services as <br /> may be necessary at any time for the Project, including such auditing <br /> services as the CITY may require to ascertain how or for what purposes <br /> the Contractor uses the money paid by or on behalf of the CITY. <br /> 2.7 Furnish required information and services and render responses and <br /> conduct its review of written materials as expeditiously as possible. <br /> 2.8 Pay all costs incident to obtaining bids or proposals from <br /> -11- <br />
