<br /> 132 <br /> This AGREEMENT is made this the 28th day of July , <br /> 19~, between the CITY OF SAN MARCOS, TEXAS, hereinafter <br /> referred to as "CITY", 630 East Hopkins, San Marcos, Texas 78666, <br /> and SOUTHS IDE COMMUNITY CENTER, INC., a Texas non-profit <br /> Corporation, 518 S. Guadalupe Street, San Marcos, Texas, 78666 <br /> hereinafter referred to as "ADMINISTRATOR", for the coordination <br /> of the development of ten (10) new homes in the Victory Gardens <br /> and Dunbar neighborhoods (the "Project") as part of the Texas <br /> Community Development Program ("TCDP"). <br /> WITNESSETH: CITY and ADMINISTRATOR do hereby agree as <br /> follows: <br /> AR"rICLE 1 <br /> DEFIBITIOK OF TERIIS <br /> 1.1 Grant Consultant: The consulting firm of Haynes-Eaglin- <br /> <br /> Waters, 6448 Highway 290 East, Suite E-102, Austin, Texas 78723, <br /> under contract with the CITY to provide professional services in <br /> connection with the Texas Department of Housing and Community <br /> Affairs Affordable Housing Program. <br /> 1.2 Neighborhood-based Nonprofit Organization: An organization <br /> whose purpose it is to promote community development activities on <br /> a not-for-profit basis within a neighborhood, a majority of either <br /> its membership, clientele, or governing body must be residents of <br /> the neighborhood where the TCDP-assisted activities are to be <br /> carried out. <br /> 1.3 Neighborhood: A geographic location within the jurisdiction <br /> <br /> of a unit of general local government (but not the entire <br /> jurisdiction) designated in comprehensive plans, ordinances, or <br /> other local documents as a neighborhood, village or other similar <br /> geographical location; or the entire jurisdiction of a unit of <br /> general local government which is under 25,000 in population. <br /> ARTICLE 2 <br /> ADKIBISTRA"l'OR . S SERVICES AIm RESPONSIBILITIES <br /> 2.1 S'lARDARDS OF PERFORIIARCE <br /> 2.1.1 The ADMINISTRATOR certifies that it is a neighborhood-based <br /> nonprofit organization defined in Paragraph 1.2. <br />
