<br /> c.¡ fR '2 <br /> twelve (12) months will be discharged. <br /> Positions vacated because of employee disabilities may be filled by temporary or regular <br /> employees depending on the needs of the department. The City Manager will decide on <br /> whether or not to fill the vacancy upon the recommendation of the department director and <br /> the Director of Human Resources. If the employee is fully released for return to work to <br /> his/her regular position within six (6) months, he/she will be reinstated to that position. <br /> An employee who is, or expects to be, absent from work for medical reasons for five (5) <br /> consecutive working days or more must apply for a leave of absence. To qualify for such a <br /> leave, the employee must report his/her disability to the supervisor in writing as soon as <br /> possible. The employee must also provide a written statement from the doctor setting forth <br /> the nature of the disability, the date the disability began or will begin, and the approximate <br /> date the employee will be able to return to work. The department director and the Human <br /> " <br /> Resources Director will consider all disability leave requests for approval/denial. During the <br /> leave, an employee may be required to furnish a similar report from the doctor whenever <br /> requested by the City. <br /> B. Compensation: Occupational Injury or Illness <br /> Employees who are injured in the course' of employment are eligible for disability pay <br /> under the Workers' Compensation Insurance program. During the initial thirty (30) calendar <br /> days of disability leave, the City will pay the employee the difference between the Workers' <br /> Compensation disability payment and his/her regular (non-overtime) after-tax wages or salary, <br /> and the employee's accumulated sick leave benefits will not be charged. If the employee <br /> remains disabled after thirty (30) calendar days, the employee may use his/her accumulated <br /> sick pay benefits to supplement the disability payments from Workers' Compensation until <br /> October 1992 Employee Handbook - City of San Marcos Page 4 - 4 <br />
