Engineering oversight will be <br /> provided by Mr. James G. Bierschwale, P.E. <br /> 2.3 STANDARDS OF PERFORMANCE SwL's services will be performed under <br /> <br /> the general direction of a licensed Engineer. Its findings obtained <br /> and its reports prepared in accordance with its proposal, this <br /> agreement, and with generally accepted principles and practices. In <br /> performing its professional services, SwL will use that degree of care <br /> and skill ordinarily exercised under similar circumstances by members <br /> of its profession. SwL agrees to promptly notify the CONSULTANT as <br /> specified in Paragraph 1.2 when it appears that materials tested or <br /> inspected are in noncompliance. CITY assumes sole responsibility for <br /> , <br /> ~etermining whether the quantity and the nature of the work ordered is <br /> adequate and sufficient for the CITY's intended purpose. <br /> 2.4 TESTS AND INSPECTIONS All tests and inspections of the site, <br /> <br /> materials and work performed by SwL shall be timely and properly <br /> performed in accordance with the plans, specifications and contract <br /> documents, and SwL's recommendations. All reports of tests, <br /> inspections and services performed shall be complete and factual, <br /> citing the tests performed, methods employed, values obtained, and <br /> parts of the project area involved. SwL further agrees to utilize <br /> testing equipment which has been calibrated according to individually <br />
