<br /> 13.5 Whenever a period of time is prescribed for action to be <br /> taken by either party, the party shall not be liable or <br /> responsible for, and there shall be excluded from the computation <br /> of any such period of time, any delays due to strikes, riots, acts <br /> of God, shortages of labor or materials, war, governmental laws, <br /> regulations, or restrictions or any other causes of any kind which <br /> are beyond the reasonable control of that party. <br /> l3.6 The CITY covenants and agrees that, upon paYment by HCAD of <br /> the rent and all other sums and upon the observance and <br /> performance of all of the covenants and agreements on the HCAD's <br /> part to be observed and performed, HCAD shall, subject to the <br /> terms and provisions of this Lease, at all times during the <br /> continuance of this Lease have the peaceable and quiet enjoYment <br /> and possession of the premises. <br /> l3.7 Nothing in this Lease shall be deemed or construed by the <br /> parties, nor by any third party, as creating the relationship of <br /> principal and agent or of partnership or of joint venture between <br /> the parties. It is understood anti agreed that neither the method <br /> of computation of rent, nor any other provision of the Lease, nor <br /> any acts of the parties, shall be deemed to create any <br /> relationship between the parties other than the relationship of <br /> landlord and tenant. <br /> l3.8 HCAD warrants that it has no dealings with any broker or <br /> agent in connection with the negòtiation or execution of this <br /> Lease and HCAD agrees to indemnify and hold the CITY harmless from <br /> and against any and all costs, expense or liability for <br /> commissions or other compensations and charges claimed by any <br /> broker or agent with respect to this Lease. <br /> l3.9 Should HCAD fail to pay when due any installment of rent, or <br /> any other sum payable to the CITY under the terms of this Lease, <br /> the CITY may charge interest at the maximum legal rate payable in <br /> the State of Texas and the interest shall accrue from and after <br /> the date on which it shall be due and payable. The interest shall <br /> be paid by the HCAD to the CITY at the time of paYment of the sum <br /> upon which the interest shall have accrued. <br /> -9- <br />
