<br /> ARTICLE 14 <br /> MISCELLANEOUS <br /> 14.1 If any clause or provision of this Lease is illegal, invalid <br /> or unenforceable under present or future laws in effect during the <br /> term of this Lease, it is the intention of the parties that the <br /> remainder of this Lease shall not be affected, and the parties <br /> declare that this Lease would have been entered into without the <br /> unenforceable portion. <br /> 14.2 This Lease may not be altered, changed, or amended, except by <br /> instrument in writing signed by both parties. The terms, <br /> provisions, covenants and conditions contained in this Lease shall <br /> apply to, inure to the benefit, and be binding upon the parties, <br /> and upon their respective successors in interest and legal <br /> representatives, except as otherwise expressly provided. <br /> 14.3 The captions used in this Lease are for convenience only and <br /> do not in any way limit or amplify any terms and provisions. <br /> 14.4 One or more waivers of any covenant, term or condition of <br /> this Lease by either party shall not be deemed to waive or render <br /> unnecessary consent to or approval of any subsequent similar act. <br /> 14.5 Whenever a period of time is prescribed for action to be <br /> taken by either party, the party shall not be liable or <br /> responsible for, and there shall be excluded from the computation <br /> of any such period of time, any delays due to strikes, riots, acts <br /> of God, shortages of labor or materials, war, governmental laws, <br /> regulations, or restrictions or any other causes of any kind which <br /> are beyond the reasonable control of that party. <br /> 14.6 The CITY covenants and agrees that, upon payment by CA of the <br /> rent and all other sums and upon the observance and performance of <br /> all of the covenants and agreements on the CA's part to be <br /> observed and performed, CA shall, subject to the terms and <br /> provisions of this Lease, at all times during the continuance of <br /> this Lease have the peaceable and quiet enjoyment and possession <br /> of the premises. <br /> 14.7 Nothing in this Lease shall be deemed or construed by the <br /> parties, nor by any third party, as creating the relationship of <br /> -9- <br />
