<br /> without any notice or demand whatsoever, including the entry upon <br /> the leased premises without being liable for prosecution or any <br /> claim for damages, and do whatever CA is obligated to do under the <br /> terms of this Lease. <br /> 12.3 CA agrees to reimburse the CITY on demand for any expenses <br /> which the CITY may incur in effecting compliance with CA's <br /> obligations under this Lease. CA further agrees that the CITY <br /> shall not be liable for any damages resulting to the CA from such <br /> action, whether caused by the CITY's negligence or otherwise. <br /> Pursuit of any one or more remedies reflected above shall not <br /> preclude pursuit of any of the other remedies provided by law, nor <br /> shall pursuit of any of the other remedies provided constitute a <br /> forfeiture or waiver of any rent due to the CITY or of any damages <br /> accruing to the CITY by reason of the violation of any of the <br /> terms, provisions and covenants of the Lease. Forbearance by the <br /> CITY to enforce one or more remedies upon an event of default <br /> shall not be deemed or construed to constitute a waiver of any <br /> rights. <br /> 12.4 If, on account of any breach or default by CA in its <br /> obligations, it shall become necessary for the CITY to use an <br /> attorney to enforce or defend any of the CITY's rights or <br /> remedies, CA agrees to pay any reasonable attorney's fees incurred <br /> by the CITY. <br /> ARTICLE 13 <br /> TERMINATION <br /> 13.1 CA may terminate this Lease by giving thirty (30) days <br /> written notice to the CITY of CA's election to so terminate. The <br /> notice shall state the date of the termination. <br /> 13.2 The CITY has the right to terminate this Lease thirty (30) <br /> days after CA ceases use of the leased premises for the provision <br /> of services as a Family Planning Clinic. The CITY shall, after <br /> the expiration of thirty (30) days from the date CA ceased to use <br /> the leased premises for the stated purpose, give CA ten (10) days <br /> written notice that the CITY so intends to terminate this Lease <br /> because of the cessation of the use of the leased premises for the <br /> stated purposes. <br /> -8- <br />
