<br />the work in accordance with the provisions of the construction contract documents, whether or <br />not such work is then fabricated, installed or completed. In addition, the Engineer will monitor <br />the Contractor's corrective actions and will advise the City as to the acceptability of those <br />corrective actions. The Engineer will review the work and results of all testing laboratories as <br />required by the construction contract documents. <br /> <br />1.7.16 Review and make all decisions regarding the approval or taking of other appropriate <br />action upon the Contractor's submittals, including but not limited to, shop drawings, product data <br />and samples, schedule of values and progress schedule and verify that submittals are consistent <br />with the requirements of the construction contract. Such action will be taken with reasonable <br />promptness, but generally not to exceed 30 days or such period of time as will not cause delay of <br />the Project. The Engineer will advise the Contractor of any areas where the schedule is not in <br />compliance with the construction contract and will provide comments to the City to assist the <br />City in approving, accepting or taking other action on the contractor's schedule, in accordance <br />with the construction contract In addition, the Engineer will review the Contractor's periodic <br />schedule updates or other schedule submissions and will advise the Contractor if the updates or <br />other submissions are not in accordance with the construction contract. The Engineer will <br />provide comments to the City regarding the updates or other submissions as provided by the <br />Contractor. The Engineer's review and comments will not be considered as a guarantee or <br />confirmation that the Contractor will complete the work in accordance with the contract for <br />construction. <br /> <br />1.7.17 Provide written responses to the Contractor's request for interpretation or clarification of <br />the contract documents and will obtain from the Contractor a proposed shop drawing and <br />submittal schedule, which shall identify all shop drawings, samples and submittals required by <br />the contract for construction, along with the anticipated dates for submission. The Engineer will <br />provide review ofthe Contractor's shop drawings, samples, and other submittals and will log and <br />track all shop drawings, samples and submittals. It is assumed by both parties that less than <br />30 submittals and 15 re-submittals will be made by the Contractor. The Engineer's review of all <br />shop drawings, samples and submittals will be for general conformance with the design concept <br />and general compliance with the requirements of the contract for construction. Such review shall <br />not relieve the Contractor from its responsibility for performance in accordance with the contract <br />for construction, nor is such review a guarantee that the work covered by the shop drawings, <br />samples and submittals is free of errors, inconsistencies or omissions. The Engineer's scope will <br />be based upon the scope of work in the construction contract and will include a maximum of two <br />submissions by the Contractor for each shop drawing, sample or submission. Should there be <br />additional reviews required due to no fault of the Engineer, the Engineer will be entitled to <br />additional compensation from the City. The Contractor performing the work will ultimately be <br />responsible for the payment of compensation due the Engineer for the performance of additional <br />reviews as set forth in the Construction Contract between the City and the Contractor. <br /> <br />I. 7.18 The Engineer will review the Contractor's requests for information ("RFI") or <br />clarification of the construction contract and will coordinate such review with the City as <br />appropriate.
