<br /> -6- <br /> criteria established in 40 CFR 403.8(f) (2) (vii). <br /> (48) siqnificant industrial user: Any industrial user <br /> of the city's wastewater disposal system who: <br /> (a) has a discharge flow of twenty-five thousand <br /> (25,000) gallons or more per average work day; <br /> or <br /> (b) has a flow greater than five (5) percent of <br /> the flow in the city's wastewater treatment <br /> system; or <br /> (c) has in its waste toxic pollutants as defined <br /> pursuant to Section 307 of the Act; or <br /> (d) is found by the city, Texas Water Commission <br /> or E.P.A. to have significant impact, either <br /> singly or in combination with other <br /> contributing industries, on the wastewater <br /> treatment system, the quality of sludge, the <br /> system's effluent quality, or air emissions <br /> generated by the systems. If a user is found <br /> to have no reasonable potential for adversely <br /> affecting the POTW, the user may be re- <br /> classified. <br /> (49) Solid waste: Any garbage, refuse, sludge and other <br /> discarded materials, including solid, liquid, <br /> semisolid or contained gaseous material resulting <br /> from industrial, municipal, commercial, and <br /> agricultural operations and from community and <br /> institutional activities. <br /> (50) SS (suspended solids): Solids that either float on <br /> the surface of, or are in suspension in water, <br /> sewage, industrial waste, or other liquid and which <br /> are removable by a method approved in 40 CFR 136, <br /> expressed in milligrams per liter (mg/l). <br /> (51) SIC (Standard Industrial Classification): A <br /> classification pursuant to the Standard Industrial <br /> Classification Manual issued by the Executive <br /> Office of the President, Office of Management and <br /> Budget. <br /> (52) State: The State of Texas. <br /> (53) Storm sewer: Any sewer or open drainage channel <br /> designed to carry storm and surface water, street <br /> wash, and drainage water. <br /> (54) To discharqe: To depos it, conduct, drain, emit, <br /> throw, run, allow to seep, or otherwise release or <br /> dispose of, or to allow, permit or suffer any of <br /> these acts or omissions. <br /> (55) Toxic pollutant: Any pollutant or combination of <br /> pollutants listed as toxic in regulations <br /> promulgated by the Administrator of the E.P.A. <br /> under provisions of Section 307 (a) of the Act or <br /> other acts. <br /> (56) Treatment plant upset: An inhibition or disruption <br /> of the treatment plant, its treatment processes or <br /> operations, or its sludge processes, use or <br /> disposal which is a cause of or significantly <br /> contributes to (i) a violation of any requirement <br /> of the city's N.P.D.E.S. permit (including an <br /> increase in the magnitude or duration of a <br />
