<br /> -7- <br /> violation), (ii) the prevention of sewage sludge <br /> use or disposal by the treatment plant in <br /> accordance with all applicable federal and state <br /> laws and regulations and city ordinances, (iii) a <br /> decrease in the quality of the effluent being <br /> discharged from the treatment plant, or ( i v) a <br /> decrease in the performance of the treatment plant <br /> processes or operations. <br /> (57) Upset: An exceptional incident in which there is <br /> unintentional and temporary non-compliance with <br /> Categorical Standards because of factors beyond the <br /> reasonable control of the industrial user. An <br /> upset does not include non-compliance to the extent <br /> caused by operational error, improperly designed <br /> treatment facilities, lack of preventive <br /> maintenance, or careless or improper operation. <br /> (58) User: Any person who contributes, causes or <br /> permits the contribution of wastewater into the <br /> city's sanitary sewer. <br /> (59) Waste and/or wastewater: Sewage, industrial waste, <br /> or wastes, and drainage water. <br /> (60) Water course: Any natural or artificial channel in <br /> which a flow of water, either continuously or <br /> intermittently, occurs. <br /> Sec. 30-92. Discharqe limitations and Drohibitions. <br /> (a) General Discharge Limitations and Prohibitions: <br /> No person may discharge or cause, suffer, allow, or <br /> permit to be discharged into any sanitary sewer, any of the <br /> following: <br /> (1) Other waste, unless authorized by the Control <br /> Authority. <br /> (2) Flammable or explosive liquids, solids, or gases, <br /> such as, but not limited to, gasoline, kerosene, <br /> benzene, naphthas, solvents, and similar substances <br /> with a closed cup flashpoint of less than 1400 <br /> Fahrenheit or 600 Centigrade using test methods <br /> specified in 40 CFR 261.21. <br /> (3) Pollutants regulated pursuant to any applicable <br /> Categorical Standard promulgated by E.P.A. in a <br /> concentration or in an amount which is in excess of <br /> the limit specified in such standard. <br /> (4) Organic pollutants referred to in Section 307(A) (l) <br /> of the federal Clean Water Act, and listed in <br /> Appendix B to 40 CFR 403 that are used in a <br /> manufacturing process shall be segregated from <br /> wastewater discharge to the extent it is feasible <br /> to do so. No such pollutants shall be discharged <br /> to the sanitary sewer system in a concentration or <br /> amount sufficient to cause any of the following: <br /> (A) A treatment plant upset; <br /> (B) The treatment plant to be in violation of its <br /> National Pollutant Discharge Elimination <br /> System (N.P.D.E.S.) permit; <br /> (C) Any harmful or destructive condition in the <br /> city sewer system; <br />
