<br /> § 14 SAN MARCOS CODE § 15 <br /> Section 14. Penalty. <br /> Any person violating any of the provisions of this chapter and <br /> any person who does any act requiring a permit under the provi- <br /> sions hereof without a valid permit, and any person who fails or <br /> refuses to comply with any of the provisions hereof, shall be <br /> guilty of a misdemeanor and upon conviction shall be fined an <br /> amount not less than two hundred dollars ($200.00) nor more <br /> than one thousand dollars ($1,000.00). Each day that such viola- <br /> tion continues shall constitute a separate offense. Prosecution or <br /> conviction under this provision shall never be a bar to any other <br /> remedy or relief for violations of this chapter. <br /> (Ord. No. 1984-72,§§ 14, 15, 6-13-84; Ord. No. 1984-77, § 2, <br /> 7-25-84) <br /> Section 15. Definitions. <br /> The following definitions shall apply in the interpretation and <br /> the enforcement of this chapter. When not inconsistent with the <br /> context, words used in the present tense include the future tense, <br /> words used in the singular number shall include the plural num- <br /> ber and words used in the plural number shall include singular <br /> numbers. The word "shall" is always mandatory and not merely <br /> directory. <br /> (1) Construction: Assembly of materials into a structure or <br /> structures and shall also mean the rehabilitation or replacement <br /> of a structure or structures either which have been damaged, <br /> altered or removed or which are proposed to be altered or re- <br /> moved to an extent exceeding fifty (50) per cent of the area of said <br /> structure or structures at the time of said damage, alteration or <br /> removal. For the purposes of this ordinance, the installation of <br /> parking lots is considered to be construction. <br /> (2) Development: Construction, excavation, dredging, .grading, <br /> filling, clearing, removing vegetation; provided, however, that <br /> pruning and other forms of general and regular maintenance of <br /> vegetation on developed property shall not be considered develop- <br /> ment. <br /> (3) Edwards Aquifer: Water-bearing substrata also known as <br /> the Edwards and Associated Limestones Aquifer.
